Right to retrieve

Does Ky. Not have the right to retrieve law now? If not the association needs to go to work on our politicians to get this back I had a friend go get his dog the other night had permission on a farm dogs treed they crossed a log road to more woods no fence no signs and got on a trail camera game warden showed up at his house and said you got a ticket coming he said why he told him being on property without permission not trespassing he asked what he was supposed to do call him and he told him he couldn't go with him either without permission

No they don't have it.

4. Permission for Retrievals - Permission needs to be sought from the landowner for the retrieval of hunting dogs and shot animals that have strayed onto their property. The KDWF has strict regulations on what a hunter may and may not do in such circumstances, but the onus is on the individual to avoid straying onto private land whenever possible. The landowner is under no obligation to grant permission for the retrieval of game from their property.

5. Prosecution of Trespassers - In Kentucky many KDWF owned parks and forests share a boundary with private land and trespassing is bound to happen; both deliberate and accidental. Landowners may prosecute those hunters found trespassing on their land without permission.

My understanding is call local law enforcement. The wording in Kentucky is you're not allowed too trespass in Kentucky without permission too retrieve GAME. I'm sure if you're caught retrieving just the dog a good lawyer could argue the case.

I don't care what state I am in, I am getting my dog. Too many dogs get shot every year for me to wait around. I have had my picture on a couple trail cameras.... maybe the guy who owned the camera thought I was bigfoot...

If I was a land owner and charged someone with trespassing for getting their dog or game and they didn't do anything else, I'd be afraid they'd come back and burn the woods or my barn or break my windshield. A lot of folks can be vindictive.

Retrieve

According to the Ky. Houndsman Association you have the right to recover your property and are looking into this case right now.

Right to retrieve

Don't think that has ever been a law in Ky. The Houndsmen Assc. has worked toward if for years, but pretty sure it never passed. I was on the board for several yrs. However, you do have the right to recover your personal property but you must be accompanied by law enforcement. They do not have to permission if you have proof or file a complaint.

Retrieve

The land that I own now has been in my family for the last 150 years and I'm 65 to my knowledge it has never hurt it a bit for someone to walk across it and I never heard my father or Grand father say anything about it. Some day you might need that stranger to pull you out of a ditch or a burning vehicle or even worse one of your family I would hate for them to say that's the arrogant------- just leave him be

Amen and I own a lot more property than most, I am happy that the hunters look out for things, if they see a fence down they fix it , a cow down they call me, they see someone else hunting there they leave and don't call me to complain, all I ask them is to get along and they do.

He must have his number next to his name on his posted signs. The only way I can think of. I try and be courteous. And go around to neighboring properties to the ones I'm going to hunt. And if they're a a-hole then I just don't even call. Put gun in truck go and get the dog.

That’s a rumor that’s been spread about wardens everywhere. They are law enforcement that’s all they go by the same rules.

A right to retrieve is kind of a sticky subject. How can we argue we have the right to go get something on someone else’s land? Especially when we turned it loose knowing it might get on their land. It’s not the same as a horse or a cow that got out by accident.

Every time it happens to me I do the same thing. I turn my light up and go get my dog. I make sure my light is on and visible because I do not want them thinking I’m steaking around. If I get caught I tell them I'm sorry and I'm trying to get my dog out of here before it disturbs them. Has worked every time. I've took a cussing or two but I have also gotten permission in places I didn’t have before. The important thing is I have never gotten a ticket.
