Judge Scalia quote

The late Justice Scalia said it best, "A constitution is not meant to facilitate change. It is meant to impede change, to make it difficult to change."
Something I completely agree with. It seems odd to me that the last two appointments to the Supreme Court say that the Constitution is outdated.

The document will never be out of date, but interpretation could be, even those of Justice Scalia....

This is one of the most critical appontments in the history of our nation. We are truly at the tipping point. Hopefully towards the true textual interpretation of the constitution.

I'd really like to respond in a method consistent with the Constitution, and the intents and understandings of our founders; but, I can't find my quill pen, ink, or papyrus. Even if I could, I'm sorry to say, I don't know where our local Pony Express Station is. How could I get my message to you???

If you get this message, you are certainly not a strict constitutionalist. You've embraced change, and even use it for communication purposes. You consider the Constitution as a living/changing document. If I'm wrong, you will not receive this message.

One if by land, two if by sea, three if by air. Wait, we didn't have air travel then. If you traveled by air, you were a God or an alien. I've traveled by air. So, am I a God or alien (superior being)? You?

If you drive a car, travel by air, have electric in your house, have a computer, or communicate via the internet, YOU MOST CERTAINLY ARE NOT A STRICT CONSTITUTIONALIST!!! The founding fathers never anticipated this.

I think it's fair to say that you have much more in common with our last two Supreme Court appointments than you do with our founding fathers. Again, if I'm wrong, you won't get this message (it's not Pony Express).

Our guiding principal should be fairness and equality for all!!!

I'm not criticizing as much as I'm trying to make you THINK!!! Sometimes, all of us have these "DUH" moments. Me too. My daughters will testify!!!

Thank you. I have many duh moments. I've misplaced my keys and wallet on occasion. I've flipped my glasses on top of my head and wondered where I put them.

Sometimes my Garmin tells me: "dog has treed quarry". and I can't see anything! DUH!

But, I don't confuse 1787 (Constitution) and 2016 (Today). I think we should acknowledge that there have been changes in 229 years. To deny that would be "duh" stupid!!!

Nope you're wrong. It's why the Constitution has only been amended 27 times in all these years and most of those amendments were not significant changes, but only clarifications. Such as the Bill Of Rights. The Founding Fathers in their wisdom set it up that if something needed to be changed later it would have to go through a very difficult amendment process. Not changed willy nilly because of a latest poll or political judgement of some Judge trying to make law. It's the litmus test for all those things. If it doesn't stack up to the Constitution, it doesn't pass mustard in this country. Period.

I figure one day again in our land we will be fighting each other. One to uphold it and one to rip it down. Be guns and all. So we shall see how much certain folks are in 2000 whatever verses 1787.

Since you post was directed at me I will answer this one time. Nothing you posted has anything to do with the constitution, it has to do with progress in industry and the ideas and work of people. The founding fathers made sure if any additions, subtractions, or change to the original document 2/3 vote in both house and senate and then would take 3/4 of states to pass it. This will be my last post on this thread

It's been a long time since law school. I've forgotten a lot. When some of our finest legal minds (Supreme Court) can't agree on what the Constitution means, that's a problem. It's interpretations rather than actual intent that causes problems. It's when agendas take precedence over objectivity that we encounter problems. When you study Brown vs Board of Education, Plessy vs. Ferguson, you will see it's not the Constitution that changed, it's the composition of the Supreme Court. The Constitution remained the same, but we had different interpreters.

That said, 1787-2016 = 229 years. The world is very different today. I have no clue where it will be in 2245 (another 229 years). I don't think anybody else has a clue either. That said, some principles and values are timeless. Respect others, and the opinions of others (you've done that, and I respect you for it). Respect family values, religious values (if they don't infringe on the rights of others---no respect for jihaad).

Outdated Issue. Remember, women could not vote (they were chattel), blacks could not vote (they were slaves), non land-owners could not vote. It was an aristocratic society. Do we really want to go back to that??? Not me.

Challenge: Read the original Constitution. Tell me what it says about women's rights, black rights, workers rights. Hint: They were non-existent. They were gained by battling against the establishment. The establishment fought hard against these initiatives. They are still fighting (have their own propaganda networks--- Fox---MSNBC). They try to divide working class America on social/value issues. We need to resist this divide/conquer tactic.

Look at our two non-establishment candidates:
(1) Sanders. The Democratic establishment/crime family/MSNBC is against him.
(2) Trump. The Republican establishment/crime family/Fox News is against him.
This encourages me to be for these guys.

Re: You labeling me with the Socialist Party. I've never been a part of that. But, if that's the label you want to apply to someone that supports the working class (I'm working class), I'll proudly accept that label because I'm all for the working class!!!

I like to think I'm open minded, but must confess: I DO NOT support Cruz or Rubio for El Presidente'.

A persons "sex" was never mentioned in the original Constitution for the United States . The Constitution did not prohibit women from voting , the Constitution actually used terms that are "politically correct" today . Voters qualifications were left up to states , much as they are today . We now have amendments that force states to recognize a woman's right to vote but nothing in the original Constitution prohibited women's rights .
Also the subject of race is never mentioned in the original Constitution . There is "persons held in service or labor" for the 3/5ths value , as I am assuming you know the people held in service and labor spanned many colors and nationalities . The original Constitution didn't discriminate based upon a persons race or sex . Individual states and people did that .
Socialist , if you believe in redistribution of wealth and an expanded federal government that infringes upon state and individual rights , yhink hard before you check the box for BO's successor .
Speaking of our chief , shouldn't he be attending Justice Scalia funeral ?!

The founding fathers for the most part only believed that landowners should vote and participate in government, women were granted the right to vote in `1920 by constitutional amendment...

Yes that is when an amendment was made to the constitution which forced states to allow women to vote but before the 19th amendment was passed the Constitution did not prohibit women from voting . As I stated above the original Constitution for the United States never mentioned gender .
