Yes I have seen this happen before. The Hound is actually baying the coon that refuses to move much out of one area of water(swimming circling) It is considered a tree if the dog is stationary enough (bay type treeing). Like I say, it is a judgement call and depends on what judge you have.
If the judge and cast walk up to the water and the coon is swimming in a direction 'A' to 'B', track is still open. But if it seems to be a place of refuge what the coon thinks is(and judge)(and majority cast). The dog baying it is considered treed and plus pt.s if called treed. And if he hasnt caught it or put his teeth in it.
