Personally I scratch the dog that I seen start it. If I don't see which dogs starts it then I have no choice but to scratch them both. I think many dogs that are not mean, but get caught up in a fight, (WAY TOO OFTEN) get scratched for defending themselves.
There is a BIGGG defference between an aggressor and a defender yet in most cases, they will both get wrote up for being mean, especially so if its going to allow the other guy(s) in the cast to hunt alone for the rest of the night.
A dog that is giving ground, but yet still challenging the aggressor to leave him/her alone or there's going to be trouble, is not necessarily mean and may simply be telling the bully to leave them alone or there's going to be trouble. It is not fair to write that dog up yet most of the time that is what happens.
Many hunters don't seem to know how to read body language of dogs well enough, when arriving at the tree, to interpret who is pushing on who. That dog that keeps pressuring the dog to move to the back side of the tree or get thrown over the hill is usually the aggressor but will most always get the second dog scratched as well, when exhibiting this behavior.
I would like to see the rule changed to read something like this;
Upon arrival to a tree where aggressive behavior is being exhibited, Judge is to scratch the aggressor if known, aggressor to be determind by the dog witnessed initiating (INITIAL) contact in view of the judge and/or majority of the cast members, and have them written up, (scratched for fighting). If aggressor is not known, and dogs are (in battle) with physical contact evident, scratch all dogs involved and have them written up.
If aggressive behavior is evident but NO phisical contact is observed Judge is to disqualify the dominant dog. Dominance to be determined by dog that is holding the dominant position on the tree, and exhibiting face barking and/or voice inflection behavior. If unable to determine which dog is holding (dominant) position, with face barking and voice infection evident, disqualify all involved when said behavior is significantly effecting the ability of any dog(s) ability to tree up on the tree.
Three disqualifications equal one scratch. Three scratches follow existing UKC protocol.
Just my opinion and with that and about one dollar you can buy a cup of coffee and enjoy it with your friends. Good Luck on this one.
