Assuming you meant "scratchable" in place of "stretchable", I think the answer is YES, spectator shining when at least one cast member votes no is a scratch offense. I say that based on the wording of the rule "Spectators may not shine UNLESS all handlers in cast agree. If one handler votes no, then spectators cannot shine and as always, doing anything the rules prohibit is a scratch offense.
