Some land owners are very strict about hunting. Maybe they feel liable if someone gets hurt on there ground. Just a thought.

But to shove a piece of wood at you, thats threatening to me I am allowed to protect myself at this time!

The law you are speaking of says they cannot write you a ticket for your dog tresspassing on anothers property not that you can go get him.Where does it say in there that you can or cant carry a gun along? Here is an excerpt directly out of the CURRENT 2008 hunting digest for ILLINOIS

This law protects the hunter from getting a trespassing ticket if their dog "on their own" crosses over to some property that you do not have permission to hunt.

So if y`alls dogs tree somewhere you don`t have permission to hunt at 1:00 am when most are in bed you either piss them off and go get dog or wait till day light to get permission to get him?

If you intentionally release a dog onto someone else's property that you do not have permission or intentionally hunt someone else's property that you do not have permission, you can still receive a trespassing ticket. This Bill which has been signed into law means that if you are hunting property that you do have permission and the dog "on their own" crosses onto someone property that you do not have permission, you will not get a trespassing ticket.

where in there does it say ur hound it doesnt it say YOU wont get a trespassing ticket

The dnr item I posted is from 2008 it is the current law in illinois. Fact is you can argue all night long with dnr but you arent going to win. The law you are arguing about protects you from getting ticket because dog trespassed. Besides where does it say you can or cannot take your gun? It dont because the rule is refering to the dog.

Don't really matter in this case though cause the people never trespassed.

The origional post says the DOGS crossed his property but they treed OFF his property.

Later they said they followed the creek up to the dogs, again not on his property.

So bottom line is that if the story is accurate somebody was shakin an ax handle at someone that WASN'T EVEN ON HIS PROPERTY and to make it even worse it doesn't sound like they ever were on his property.

Not much excuse for that.

The original post shows why man was so pissed. It was because he thought those hounds might run a DEER off his property, not because the men were tresspassing. Them dang DEER have cost more friendships than hounds or coonhunting ever thought about. I would be willing to bet if the man didn't deer hunt he wouldn't care how many coons you treed on him.

don't really understand about the law y'all say you have that prevents your dog from getting a trespassing ticket!! I sure hope that doesn't happen to any of my mutts. Those SOB's still owe me for all those entry fees I paid!!! They said they were good for it..... but I should have known better!!!

I have been chewed out a couple of times for such things. Have been threatened once (actually he threatened my dogs not me) by a nut job that had a gun. When I'm in the wrong I will take my butt chewin' but when the line is crossed I will stand up for myself HARD!!!!!!! The axe handle (waving it, not carrying it)was way, way across the line. All that being said, I try not to hunt places that have an over reacting nut job living close by but then again I have plenty of places to hunt not everyone has that luxiury. I'd do just what your saying and boycott the Vet and pass the info along to your hunting buddies and move on to another spot to hunt and save yourself some grief. Last but not least there are always two sides to every story and it's amazing just how differently the situation can be viewed by the two parties. I also like to look into things before i go off half cocked and decide for myself who's side I'm believing. JMO

Keith a landowner doesn't have the right to shoot any dog that enters his property, unless thier person or property is endangered, that would be like shooting your neighbors cows if they got out of thier pasture and came onto your land, believe me just shooting someones dog for no reason other than those is called destruction of personal property

Jim,
This is the way marion county police, the local dog catcher and head of marion county animal control, explained it to me. I called because I am having trouble with a neighbors dogs killing my animals. In order for it to be legal to shoot an animal on your property one of 2 things has to happen the dog or animal must be 1) threatening you or your animals or 2) causing damage to your property. I can guarantee if your dog gets on someones property that you already are having problems with one of these 2 thing will have happened . So in theory not that I would but if your prize bull comes over and stomps through my wifes prize tulips or uses my car for a battering ram yes you can shoot it.

JOHN

This is what I would of done in a case like this.
I would have told the man that I was sorry that my dogs treeed close to land then i would have asked will there be a problem if my dogs get on his land ( of corse you already know there is) and i would have gatherd all the people that was with me and as I was walking out I would have called the police and asked for a officer and the DNR to meet me then we all would have went back to his house, and had a talk If there was stil;l a problem if my dogs was to go on to his land then I would press charges on him for assult with a deadly weapon . but the DNR shoukld do that on his owen or the police.

this is what happened to me one night a man came out witjh a gun told me I could not hunt where I had permishion to hunt ( he owened a 1/2 a lot I could hunt all around him I just loaded my dogs and called the police when they got there he went to jail and I went huntting.
as far as my dog getting where he is not suppose to be I'm going to go get him and if I have to pay a fine then so be it' but when ever i get new permision to hunt i stop by the other land owners and talk to them most of the time they do not have a problem with it if they do I tell them in a nice way that i will try to keep the dogs off there land but i they do go on there i'm going to go get them.

One thing for sure. I love my hounds but I ain't shooting nobody over one. Dogs ain't got souls, people do! Don't be stupid and take a life over a dog. Remember in the words of John Wick "DOGS IS DOGS".

As for the dnr being full of it, I couldn't agree more but the fact is if they catch ya breaking one of their stupid laws, you'll be the one in trouble whether you're right or wrong. Go too far and you won't be talking on this page anymore cause you won't have nothing to talk about cause they'll yank your hunting privileges and you'll be sitting at home watching tv wishing you were chasing coons. That happened to a guy I know.

Jim Timmen is right. I know this first hand. Someone shot my buddies dog which was treed in the guys back yard. Ended up going to court and his homeowners insurance had to pay $6000.
Also, middle of the night, no lights on @ the house, Im going to get my hounds. . . .period. If stopped I will politly explain and if thats not good enough they can call the cops. I will say that my politness will only last so long if confronted by someone looking for a conflict.
