its not illegal to shake an axe handle in someones face if he felt threatened, but thats besides the point, i reread the original post and once again he clearly states that they trespassed to get to the dogs, the hounds trespassed and isnt the hound an extension of the hunter, i think they are, check your law books, and the most important thing to remember is that we are all coonhunters therefor we ALL know we are NOT the most honest bunch across the board im not saying this coonhunter is lying im not saying that i dont know him at all but we are only getting one side of the story also im not judging this gentleman lord knows ive trespassed most of us have im just taking part in this conversation

If he felt threatened he would not have picked up and axe handle and walked out of his house and into the woods where there was 4 or 5 lights shining around. He would have called the cops.He went out there with one purpose and that was to be a jerk. As far as the other side I will get it. Him and his wife have been my vets for quite awhile and I like both and feel it is proper before making a decision like finding another vet to hear his side whatever it may be.I will post his response when I do get to talk to him. I have an appointment in a week and a half.

assault
1) v. the threat or attempt to strike another, whether successful or not.

This is straight out of the book It is against the law.

I didnt imply that at all . What I'm saying is I am going to hear both sides before deciding.I dont jump to conclusions. I am glad John posted this. I dont want to use anyone that is like this.I happen to know the douglas's through business transactions and both seem very nice. That dont mean that they are not capable of this. I doubt if I said your doctor was the biggest idiot on the planet that you would up and quit using him on my word now would you. Also I dont have any reason to believe John would have a reason to get on here just to lie. If you make it a habit of going around beliving the first word you hear you are not being fair.

The law in Iowa, right to retrieve is great! Just leave guns at the vehicle.
Best to know who you are on and all around. Permission from land owners are always good too.

illinois has the right to retrieve also as long as u dont take a gun but the tree our dogs treed in was not on his property because we asked him when he came out there and he told us that tree wasnt on his ground so yes we shot it out and no the coon didnt land on his side of the fence and we appologiesed for bein on his ground he waited untill 3 of us walked off and caught the fourth one by himself and shakin the axe handle in his face so yes to me that makes him a chicken sh*t i didnt put this post on here to start arguements i put it on here to let people know what kind of people we are runnin into we have never had any kind of proplem like this in this county i live in but u get people from out of town movin in and here u go u get people that want to show thier butts

il right to retrieve dogs

illinois law does not grant the right of trespass for the purpose of retrieving wounded or crippled wildlife OR HUNTING DOGS. you must secure permission from the land owner Page 8 hunting & trapping regulations. Or Call DNR they can clarirfy the law.

bornthunt you are absolutly right there is NO right to retrieve in Illinois gun or no gun . You must obtain permission. Also a landowner has the right to shoot any dog that enters his property. My suggestion would be to stop hunting around his property if possible. I am calling no one liars but I have heard from a nuetral source there is more to this story. I will still ask the vet myself.Either way an axe handle is a little much.

here is the new law that took effect u have the right to retreive if u didnt turn loose on thier ground

The Illinois Federation of Hunting Dogs (IFHD) proposed an amendment to an existing wildlife code that Senator David Luechtefeld introduced as Senate Bill SB2334. The Bill passed the Senate 55 to 0. Then Representative Dan Reitz picked up the Bill and sponsored it in the House. Other Representatives that sponsored the Bill in the House were Representative Daniel V. Beiser (D), Representative Jim Sacia (R) and Representative Patrick J. Verschoore (D). The Senate bill SB2334 passed the House 108 to 0. The Bill was then signed into law by the Governor on May 12, 2006. The law takes effect January 1, 2007.

This law protects the hunter from getting a trespassing ticket if their dog "on their own" crosses over to some property that you do not have permission to hunt.

If you intentionally release a dog onto someone else's property that you do not have permission or intentionally hunt someone else's property that you do not have permission, you can still receive a trespassing ticket. This Bill which has been signed into law means that if you are hunting property that you do have permission and the dog "on their own" crosses onto someone property that you do not have permission, you will not get a trespassing ticket.

The Illinois Federation of Hunting Dogs thanks Senator David Luechtefeld, Representative Dan Reitz, Representative Daniel V. Beiser, Representative Jim Sacia and Representative Patrick J. Verschoore for their support for the hunters and outdoor activities in Illinois

Thanks

President - IFHD

Yeah Mike you might hunt mid night till daylight but then youd be on here cryin how your dog got shot and there was no reason for it and so on when in fact you just asked for it. Why start trouble when there is no need just hunt somewhere else.

the way the law reads as posted indicates the hunter-owner will not be guilty of trespass if his/her dog goes on property does not have permission to be on if there was permission to be on the ground they were on, does not really say anything about the right to retrieve, just freedom from trespass if dog does so under the conditions mentioned, if reading correctly what was posted....

I agree, it would be hard to contain my temperment, if someone shot one of my Hounds, but you have to remember, you may end up in Prison for the rest of your life. And if not you will definately serve time, and never be able to get a decent job for the rest of your life.
I would just find another place to hunt, that is not so close to this guys property. One of these days, we will probably end up hunting our Hounds, in big pens like the Fox Hunters.

Mike problem is in this situation you are just asking for this to happen why would you be mad.Fact is shoot back and never hunt again that would solve the problem. Dont it seem easier to find another place to hunt?

John,
The law you are speaking of says they cannot write you a ticket for your dog tresspassing on anothers property not that you can go get him.Where does it say in there that you can or cant carry a gun along? Here is an excerpt directly out of the CURRENT 2008 hunting digest for ILLINOIS
