Need legal advice. Any lawyers on here

My dog crossed onto a hunting club tonight and treed. While he was treed someone shot him with what the vet said looked like a 22. Can any legal action can be taken. Vet said hes got a 50/50 chance of making it through the night. I have no idea who shot him. I was hunting on property I own that borders the hunting club. Any advice would be greatly appreciated. Thanks Jason

I know of a guy who had some trouble with people hurting their dogs u need to call police and probly notify ur game wardens and set up to meet where u were hunting and basically walk em thru your night they will have to investegate it good luck man hope your dog lives people like this make me sick they can shoot a dog at large here in iowa but have to prove they were damaging. Property or destroyin something if u get nowhere with authorities contact PETA on animal cruelty

I doubt that contacting PETA could improve the situation. They'd probly want to take the rest of your dogs away from you.

I filed a police report. I know there isnt anyway to find out who did it. But I would like to get in there back pocket. That might save the next guys dog.

I herd it was only a felony if they pushed for.it to be that's what I herd on the hank dog deal even though he was treeing in the guys yard that shot him said he snarld at him or.something like that but that's just what I herd if he shot mydog I wouldnt even call the police they still haven't fount three body's in the old ore mines by my house and they been looken longer then I've been alive.

This is one of the dumbest answers ever! Just because it was on the club does not mean a club member shot the dog.
To commit arson and then let everyone know who it was that done it would bring an indictment for sure!

Thats what the sheriff told me too. If they catch him all he has to say is the dog tried to bite him.

I know a guy who lives in NC and his neighbor shot his dog with a 22 and killed it in the kennel. He took him to court and he won! The guy had to pay for the dog which was like $25,000.00 that was for the dog, the pain and suffering. (Trauma to the family n kids) I say push it as far as you can. What would have happened if there would have been a child down there and he shot?

In Georgia their is a dog retrieval law, if you shoot a mans dog in Georgia the shooter is pretty much done for in law terms.

If so, his foodplotts would'nt grow for the next 10 years. I hate this time of the year and love it. I hate it cause of all of the deer hunters that say dogs are messing up their deer hunting.

We know what you mean about the Deer Hunters. We had the same problem @ our Hunting Club. They said the coondogs would run the deer off of the Hunting Club. They wanted us not to hunt during deer season. Until One of the Hunters Killed a large Buck Right after Steve & Ray had been hunting late that night/early morning before they shot it. Now they don't complain as much.

Was this in city or county limits? City will have more Strick laws governing this. First and it's hard to do, take your emotions out of it. Be smarter than the other guy. Go to ( on line) penal code in your state and look up what property damage is over $500 and copy the penalty for it. More than likely class a misdemeanor. Then seek restitution for that. There is a monetary value on your property whether it (tried to bite him or not). Next find out ( through your local PD or Sheriff Dept, What are the, if any, running at large laws. You could be.... Could be... Cited for this if they counter sue but I doubt it. Lastly, find out from the same what RIGHT a property owner has to shoot a Bull on a neighboring property. Leave your dog out of that mix and see what they say. When the give you that answer you need to ask them Why should my expensive dog be any different? However, getting a law enforcement to arrest and file criminally on this will be next to impossible. You will have to seek an atty to recover damages. Sorry for your dog. Although damage to property you own across a fence is criminal I feel you will get better results from trying to recover property damage in a civil court. You won't have a lot of help from law enforcement on civil

sure hope your dog makes a full recovery ! every state is different on laws about shooting dogs i would check with game warden in your state you may get farther then with police dept. pa game warden has more authority than a state trooper and needs no probable cause to search a property and investagate infractions of pa game laws and shooting a dog is in violation of pa game laws unless it has big game down fine is 5000 plus restitution !

Not sure about your state but in my state the game warden has equally the amout of power. They do not have authority to search with out a search warrant. And to obtain that they MUST have probable cause to search. Exception is plain view searches. Just to clarify that up

That's ok! Just follow the advise on the post and you'll be fine. Civil or criminal the sheriff dept are still ,by law, obligated to do an investigation. Let them know that hour r willing to take this to court and ask for their name and badge number so that they can spell it right on the subpoena. I think that might light a fire under them to do a better job of their investigation. No one likes to look like a fool in the court room.

In certain jurisdictions the club could be held liable for the actions occurred on their grounds. Might not hurt to atleast talk to an attorney.

This is a bad deal.....Unless you know who actually shot your dog, my guess is your going to be out of luck.

Sheriff's often do very little other than collect information and make a report and Lawyers get expesive very fast.
