Bear Hunters: WRC Big Game Committee to talk about bear hunting on Wednesday, July 6, 2011 at 10:00 am in the Auditorium

The Big Game Committee of the Wildlife Resources Commission will meet next Wednesday, July 6, 2011 at 10:00 am in the WRC Auditorium. For the Agenda, click on the following link:

Bear Hunters, protect your rights! Attend or send representatives to this significant meeting to join us. We will be there! One obvious concern is the possible diminishment of hunting seasons. We need bear hunters from the east and the west to oppose any loss of bear hunting opportunities anywhere in North Carolina.

Landowner Protection Act HB#762/Session Law 2011-231

The Landowner Protection Act, HB #762 was signed by the Governor on 6/23/11. The new trespass law goes into effect 10/1/11 and applies to act committed on or after that date. This is the compromise bill which emerged from the seven (7) hunter trespass bills filed this session.

In the meanwhile, hunting clubs are negotiating with landowners for new leases and written permission to hunt. Some landowners are hesitant to give permission in writing.

QUESTIONS ABOUT CHAPTER 38A LANDOWNER LIABILITY

During the legislative negotiations on hb#762, Wildlife Resources Commission employees maintained that the existing statute NC General Statute Chapter 38A provides some help in this landowner liability issue. This statute does NOT help Clubs who pay for hunting leases, as the statute is geared for landowners who allow recreational activities on their land at NO CHARGE. NEW LANDOWNER PERMISSION FORM

On the NC Wildlife Resources Commission website, there is a new, downloadable form entitled Landowner Permission Form. It is intended to comply with the new Landowner Protection Act. The form contains fill-in-the-blank lines for name of hunter, number of guests, landowner name, description of activities for which permission is granted, dates for valid permission, date of signature of landowner/lessee, contact telephone number of landowner/lessee, and signature line. I recommend you use this WRC form, so that there is no question about the legitimacy of your Permission Form. You may download the Landowner Permission Form, insert your Club’s specific information, have the Form signed by the landowner or lessee, and copy the Form for all your members.
