I don't agree. I believe the rule was written to punish the dog that was treeing on the slick, but the handler knew enough not to tree his dog on it. If I am that close and see the dog move I wouldn't minus the dog on the slick because he came in or moved after we could obviously see that wasn't where he was treed.
If the situation was reversed and the dog was treed on the tree, but the cast saw him coming into the tree as they arrive, before you said handle them, you wouldn't say the dog was at the tree.
