Coles County Coon Hunters Assoc. Stolen Timber

Please read the following as we have turned it over CPO. All action goes thru me to members. This is a law matter. We are in following process now.

First of all, absolutely do not accept any payment from the logger as it may be construed as payment of damages for the wrongful act. Instead, please contact your local Illinois Department of Natural Resources Conservation Police Officer (CPO) in order to file a formal complaint of wrongful tree cutting (i.e., timber theft). Please work with your local Conservation Police Officer to determine which course of action you should take--the CPO will likely recommend that you work with an IDNR district forester or a professional consulting forester to determine the approximate volume and value of the trees wrongfully cut.

Here in Illinois, we have an Illinois Compiled Statute, listed under Civil Liabilities, that is entitled: (740 ILCS 185/) Wrongful Tree Cutting Act.

You are doing the right thing, Jeff. It is law enforcement's job to find who illegally cut our trees.

They must have had access to the property some way and without knowing anything else, my guess is that one of our neighbors had his timber cut and they came on to our property from his land. That would make the investigation easy, the CPO only needs to ask the neighbor who was doing the cutting on his property and who gave them permission to cut on our property. There should be records that law enforcement officials could demand to see.

I know back when the club had some of our trees cut, there was a good amount of money the club made from timber sales.

I do know that topography maps on property lines are readily availible at any court house. I am currently dealing with some folks who want to put some infrastucture on my property. They provided accurate maps showing mine and my neighbor's property lines. I am sure they got them at the court house. Maybe, you would want to get a topography map from the court house if you get time. If you haven't got time, let me know and I will do what I can do.

Thank You for Idea.

Will get map and I know most lines anyway. But may help. They came in threw west and north down that big hollow then cut fence. The CPO is bringing a official in to detail how much taken, type taken ect. He will then determine value and damage. They logged everything that John Lee did last time. By the old stumps left. Mostly White Oak.

They know names, mill ect, and I will give what info I have already. It is very important no member takes a check at this time. Just burns me up at that was our savings if ever needed. Very Beautiful trees. Tops are all down in deep hollows can't even get firewood out easily.

If law enforcement knows where the logs were milled at, they probably know everything else they need to know. Your doing a great job on this, Jeff. With us having the timber in a state run conservation program, that should help us. The previous officers deserve credit for setting up that program up for us.
