Don't make any difference if he got a ticket or not. Go to court and fight it, bet the warden will walk out or not show up. Either way case dismissed.
You cannot be convicted of a crime if one wasn't committed. Couda, wouda, shouda doesn't cut it.

FIRE ARM

WAS HE IN POSSESION OF A FIREARM? IN ILL. YOU CAN'T EVEN HAVE ONE IN THE TRUCK DURING TRAINING SEASON. WHAT WAS THE ACTUAL TICKET WRITTEN FOR? IF HE HAD A GUN IN POSSESION, THAT IS PROBABLLY THE ACTUAL TICKET AND WHAT HE SAID DIDN'T MATTER ONE WAY OR ANOTHER, JUST PART OF THE STORY. <v>

That would be prima facia evidence. Unless the law specifically bans bearing arms while training would be step one , but if it did then the law itself would be Unconstitutional via Second ammendment. Prima facia evidence requires a higher degree of proof than caught in the act of shooting. The burden of proof squarely falls on the accuser , not the accused. IF he had a gun why would he not have shot the coon instead of SAYING he would have? Who said he had a gun at the truck anyway?Imagination?

We all go along just to get along with alot of laws that are Unconstitutional. Fight it whether there was a gun in the truck or not.

That's a good example right there. Why do we check with a government agency to find out what their interpretation of the regs that they enforce are? I would suggest to Mr. Cain when he is elected to create just one more agency. Made up of a pannel of sure enough Judges that have knowlege and apply the Constitution on behalf of the Citizen, that you can call on the cell phone from the woods and get an answer before you hang up and give up. Why ask the Fox about the rules of the Henhouse? This is our Government and it is supposed to work for us, not us for them. Let's take our Government back where we are the dog and the tail wags because we tell it to and not allow our tails to wag us?

I would say your only getting part of the story, any game warden in his right mind would know that this would not past muster with any prosecuting attorney. Remember the prosecutor has the last say, he decides whether or not to file the charges. You hear alot of this kind of nonsense on the internet, sad part is most leave out the part of them having a loaded gun in the truck, or other violation. If it is true all he has to do is take his side down to the prosecutor before it ever goes to court. I used to be a reserve deputy and spent quite of bit of time riding with a federal game warden, I never saw the guy get out of line, but heard and seen every story in the book why they though they weren't breaking the law.lol If people were honest with him, he would often give them a break, once they started lying and covering up it was all over. It's always law enforcement's fault, no one is capable of a violation. I knowingly violate the code by carrying a handgun during training season, but I'm willingly to take the fine if I can't reason why I carry it, but I don't kill out of season unless a dog catches one on the ground. I carry it for self protection, too many idiots, meth heads out at night in this country.

So what did that cost you? A nights sleep? , taking a day off to go to court and he don't show and you are HAPPY because of Case Dismissed? Heck no, I would not be happy. Instead of being in court defending his rediculous Charge, he is out in the field intimidating one of your very own neighbor Citizens, Saying all the time, "I could have done this but i will give you a break" B Fn S. There needs to be a system in place that requires the accuser / agency to show and defend and there needs to be a definate DEMERIT system ( as opposed to Fines for Citizens) in place for Game Wardens that Bare False Witness to their allegations, such that when the Demerit Points are exceeded , They lose their retirement Benefits just for starters. then their jobs if they keep on being Selfrighteous and can't learn or just don't get it. That would save us taxpayers Great expense if we did not have to pay for a no account Liars retirement. What retirement do we have? None, it went to paying off Court Costs against a Civil Servant's False Accusations. No hide off his ass.

My kids were in preschool . I said I will check them out Friday because we will go to the Orangeburg Fairgrounds` to see the Garnd American, She said I hope you will reconsider, We had planed to take the children Friday to the Fire Department. They will recieve the new Stainless steal Firetrucks and have lectures provided by the fire Department.

I am thinking back to when I was brainwashed withthat kind of stuuff so iasked her? How about new stuff? you know you are smarter thanme because you and I graduated together and you got Magna *** Laude and I barely got out of the institution. she axed , What? and you got a fre ride through College to get a BA in Education and it took me ten years to get a BS including three hundred hours of Lab time with minimal credits per hour served. And Let me see? Now you want to indoctrinate my kids to be Government servants? and hold their head uphigh ? are you kidding me? She said you just do not know that they will be your servants , They will be your Masters. She was honest way before her time.

l.lyle- those so called reserves are your good ol' rent a cop !
This does sound like what might happen when a brand new, gung ho type gets his first little job as a gamewarden. Probably right out of the MP's and used to pushing enlisted folks around ...

l.lyle, How many cases have you taken to court? How many cases have you taken to court and won?

Now don't go getting your boxers in a wad, I agree that we should fight more of these tickets rather than pay the fine and move on. I was just curious.

Lyle, what I'm saying is that there are some good people out there in uniform, sure there are bad apples in anything, I know coon hunters that are good law abiding hunters and I know some that break every game law there is, even some who were caught stealing baby calves by putting them in their dog box. It isn't right to dump them all in the same category, hell, around here if we didn't have a game warden we'd have most game poached out in my area. You must not understand the legal system, the prosecutor can either decide to take a ticket or charge to trial or dismiss it, and here you can bet your hiney the officer will be there in court when the case is heard.
Nobody is ever guilty it seems, these guys just go around dreaming up crap to hassle hunters,,,,,,,roflmao it's always the same story on most forums, their are three sides to every story, the offender's, the officers and somewhere in there the truth. The guy is far from an a hole as you put it, the guy hunts, fishes and coon hunts like the rest of us, he just does his job as fair and square as it can be done, it's a thankless job, especially when guys like you think they are all government lackies. Kids being brainwashed by the fire department?, what a thought process. I guess us guys who served our country in the military are just government indoctrinated lackies/servants.

I didn't say all of them were good, read the post. Their are good and bad folks in all professions, in your case justice was served by a judge with common sense. I'm just saying there are also some good ones out there that use common sense, to say they are crooked is way off base. The one I know will even tell the judge in his opinion a guy was killing a deer to feed his family if he truly thinks it is the case, asking the judge to fine them court cost only and keep it off the record, but if he thinks your out killing them just for taking racks he'll hang your hiney.
