It states thate the new ordinance is doing away with the $4.00/$10.00 dog fee but is placing heavy restrictions on Hybrid animals and can only be kept if they are Spayed or Neutered.....
MORGANTON - A proposed county animal ordinance would do away with a license fee but would impose penalties for violations.
A public hearing on the ordinance will be held tonight during the Burke County Board of Commissioners meeting in the county services building at 110 N. Green St. in Morganton. The meeting starts at 6 p.m.
Lt. Steve Massey with Burke County Animal Control was involved in the process of coming up with a new ordinance. He said it does away with the county license fee, which was $4 for spayed or neutered dogs or $10 for those that were not.
The proposed ordinance also calls for the ban of dangerous exotic animals or reptiles, or hybrids of what is considered a dangerous animal such as a cross between a wolf and dog.
The state doesn't allow any wildlife to be vaccinated, Massey said.
"Anything that can't be vaccinated (is) a public health issue," Massey said.
But for those who already own an exotic or hybrid animal, the ordinance allows them to keep it as long as it's spayed or neutered. Those not spayed or neutered would be seized and euthanized.
The penalty for violating any part of the proposed ordinance is:
- First offense — $50
- Second offense — $100
- Third offense — $200
- Any offense after the third — $200 per incident
If someone doesn't correct a violation within 10 days they would be fined $50 per day until the violation is corrected, according to the ordinance.
Before, the penalty was $25 and $25 for each subsequent penalty, Massey said.
If someone's dog or animal, unprovoked, bites, attacks or kills a person, the owner would have to pay a civil penalty of $300, the ordinance says.
The ordinance could not be enforced in a town or city limits unless it adopts a resolution giving the county the right to enforce the ordinance within its boundaries.
The new ordinance also would strengthen the county cruelty regulations.
Massey said the proposed ordinance spells things out more clearly than the current ordinance, Massey said
