I can't believe something so unconstitutional has gotten this far.

WOW ! I can't believe it either !! That will knock out half of our planned competitons for this year !! No way I would take a chance on losing my hounds by crossing the state line with them...Is that how I am understanding this?

Sounds

like some of the kennel clubs need to make some of those calls to!Laws like this gona effect their pokets big time.Cant beleave those guys down there let it get that far.Sure would put a damping on a state hunt or large sectional.

Sporting Dog Alliance is the best source for info and also going to bat for us NATIONWIDE. JOIN JOIN JOIN!
The Texas Responsible Pet Ownership Alliance (RPOA) is a GREAT source of information & help. They just successfully helped dog owners defeat bad proposed laws in Plano, Texas.
Texas B&T CHA donated $50 to RPOA this weekend.
RPOA is putting together wordage we can use in person, in letters, FAXES and emails NATIONWIDE to inform legislators & lawmakers about bad proposals. They will be sending it out to anyone needing help.

URGENT: Oklahoma Measure Would Restrict Movement of Breeders and Allow for Unreasonable Search and Seizure

The AKC is extremely concerned about provisions in Oklahoma House Bill 1332, as written, and urges all Oklahoma dog fanciers, owners and breeders to contact their representatives to express their concerns.

The AKC promotes responsible dog ownership, responsible breeding practices, enforcement of cruelty laws, reasonable inspection programs and nuisance regulations. However, HB 1332 does not improve the welfare of animals and would punish fanciers, breeders and responsible owners who participate in dog sports and/or breed in Oklahoma.

The AKC is disappointed that although the bill’s sponsor agreed to address concerns about this measure voiced by the AKC and its federation prior to bringing the measure to the floor, these discussions have not yet taken place.
Provisions of HB 1332 would:

* Duplicate existing federal laws and also require that anyone who is a breeder, person, firm, corporation or other association that qualifies and is certified as a breeder, dealer, animal rescue, out-of-state dealer/breeder, shelter, or retail pet store that sells, gives away, or transfers a cumulative total of 25 or more animals of any age in any one (1) calendar be subject to licensure and inspections that mirror USDA standards. This includes all animal rescue organizations that utilize foster homes if they transfer more than 25 animals per calendar year, but excludes all shelters.

* Stipulate that out of state breeders cannot transport animals in Oklahoma without a state license.Although substitute bill provisions allow for the exclusion of those who participate in dog shows and field trials, it does not cover those who travel into Oklahoma for other dog-related events such as training sessions, matches, hunting activities and public education events that are not classified as a dog show or field event.

* Require the Oklahoma Department of Agriculture to develop and implement regulations pertaining to this bill, but does not guarantee public input or representation from stakeholders. Experts and responsible breeders should be consulted in the development and implementation of such regulations.

* Provide for warrantless search and seizure by poorly-defined enforcement personnel. The measure states, "Oklahoma Department of Agriculture, Food and Forestry personnel and agents shall have the right to enter the premises of an individual or facility and conduct inspections." The bill language does not define an "individual". This appears to leave the door open for those that do not qualify to be subjected to unwarranted searches and seizures. The legislation should state specifically that inspections/searches pertain to only those that are applicants and/or licensees.

* Provide no element for public education or consumer protection and attaches all the responsibility to breeders. It provides no incentives for those who follow ethical guidelines established by parent breed clubs, or obtain health and genetic testing to ensure consumers have healthy quality family pets. Responsible breeders follow ethics guidelines and existing federal laws.Rather than to bring substandard kennels up to par, HB 1332 will cause them to hide from regulators, making identification and enforcement nearly impossible.

HB 1332 continues to impose punitive measures that duplicate federal efforts. This bill will have a negative impact on responsible breeders with valid USDA licenses, those that visit Oklahoma for recreation and legitimate organizations that provide a valuable rescue services to animals.
The AKC and its federation encourage animal advocates to look for solutions to community pet issues. However, HB 1332 as amended cannot solve the issues of producing healthy pets for consumers and eliminating substandard breeding practices.

Dear Rep. Kiesel, Kevin Duck from Konawa here. Wanted you to know that I strongly oppose HB1332 titled the Oklahoma Pet Quality Assurance and Protection Act. It shameful that this legislation is coming out when there is already appropriate laws on the books to prevent the abuse of animals in Oklahoma and other states as well especially at a time when the people of Oklahoma are facing daunting economical hardships with no sure relief in sight. Because I believe that you care for the residents of Seminole County as well as Oklahoma, a bill like this may not catch your eye as significant as you are concentrated more towarsd the economic downturn. Also you may not realize how bills like this one are showing up arount the United States but just to let you know Indiana, Illinois and Pennsylvania at this moment are also faced with very similar bills. So while you are working hard to better the economy of Oklahoma, special interest groups are slipping in legislation that by its very title seems innocent and good. However this bill will adversly affect every dog enthusiest in Oklahoma. From Bird Dogs to Border Collies, those of us who love to spend our free time enjoying the companionship of our dogs and sharing that long lived heritage with our children will be stifled. I am at this time hunting four 8 month old pups that I raised, owning both the sire and the dam. There is such a great feeling of accomplishment seeing the pups that I have nurtured grow to do what they were bred, born and love to do. I know many in the state who share my passion for improving the breed of dogs we enjoy.Also Ryan, this bill cannot be looked at as a one time legistlation. History reveals that special interst groups such as HSUS and PETA work in "incrementalism" -- taking very small steps to make small gains and establish new public policy precedents that can be exploited and expanded over time. This will be one more step to steal the rights of Oklahomans who have enjoyed sporting dogs as companions and help mates to their families for generations.I would also like to make you aware of couple things that might not be common knowledge unless you are a pet owner that also breeds for the future. AKC, The American Kennel Club, has field reps that visit pet owners who raise pups either to sell or for future compainions. The number of times a field rep. visits is dependent upon the amount of litter an individual raises. So those that are raising several litters a years are visited regular while the hobby breeder is visited once every 12 to 18 months. Records are checked on each individual dog and then facilities as well as the health and demeanor of each dog is also viewed. Another thing the rep. will do is look at those dogs on the premises that are not AKC registered to insure they to are being cared for and show signs of a healthy happy dog.Another thing is for those who sell pups to brokers/agents. They must be USDA certified. These breeders are brought under even a closer scrutiny. Where AKC can put a pet owner on probation the USDA can shut a breeder down. Both agencies can and will report any abuse they witness and then it becomes a legal matter and abused pets can be taken into custody and both agencies when abuse or neglect is found can and will bring guilty parties under the guys of the law.I will be watching very closely how this bill is handled, who supports it and who does not. I have supported you from the start of your career. I believe that I have supported a man who will here the voice of the people, act for the people and will see this legislation for what it is; incrementalism by a radical special interest group. Please be a voice for your supporters and not only oppose HB1332 but also help others representatives see the adverse affects this bill will have both short term and long term on the responsible pet owners, sporting dog enthusiests and good folks of Oklahoma. No good can come from this bill. As an avid coonhunter, I will write letters to my state senotors, legislaters, and Brad Henry every day to oppose this bill. I strongley disagree with the entire bill.Oklahoma houndsmen now is the time for all of us to put away our differences as far as breeds and types and ban togethor to fight this bill and conserve our hobby, sport, and for some livelyhoods, for the better of our state and country. Come on guys and gals lets beat this.

My letter to Brad Henry

Mr. Brad Henry,

As a born and raised Oklahoman, I have been raised with morals and values that I believe are essential to the growth of any young man or woman. I have served my country both overseas and on home soil. Most of the morals and values that I have been taught have been taught to me while out on a coonhunt with my Grandfather and Father. Some consist of responsibility not only to myself but to my dog as he is doing a job for me, trust, hardwork and dedication among others. House Bill 1332 is going to destroy these key lessons for my kids in the future. It takes away the right to own and raise animals. I belive that is why we call ourselves America, not only for freedom of religion but the right to the pursuit of happiness. We as Oklahomans represent what is left of our heritage, a heritage that has lived out many bills, laws, and organizations attacking our way of life. As americans we have the right to experience the bond that happens between a man and his dog, cat, or any other animal that a human being can bond with. This bill rips every Oklahoma of that right. This will just continue on and eventually attack the FFA and 4-H programs in the future. I was in HS when we represented you with an Oklahoma FFA jacket. I was proud to have you as our Governor as you stood up for FFA and 4-H as well as all other agricultural programs. Houndsmen in the state are worrying that our right to hunt, which is how this country made it, is going to be taken away. I look forward to your response on this issue and continued support in the fight to preserve our country our state and our heritage.

in a time of hard economic conditions it also should be made clear the money that is spent by participants in dog events in the area of the events.

I contacted a representative friend of mine out of Burnsflat. I am posting his response to me and what we can do if anyone is interested. It has not been voted on by entire house and is not in the Senate yet. The best thing we can do is contact out representatives and have it knocked down before it can get any further. It will take the voice of the people. Just wanted to share what little info I had. I sent him the link to this forum so that he could read what you guys are saying and concerned about. Send the link to your representatives and let them know that hard working honest people are concerned and could mess up what fun we can have in this hard economic time. Here is what he replied: Thanks

"As for the bill you are concerned about, it is House Bill 1332, and yes its intent is to crack down on puppy mills. But you are correct in that it goes way too far, and punishes honest breeders.



As the bill currently stands, I’m certainly against it. It passed out of a House committee, but it has not been voted on by the entire House yet. I suspect because the author, Dr. Denney, doesn’t have enough votes to pass it. I seriously doubt she will be able to.



As for what you might be able to do? Breeders have done a very good job of communicating with us. I would sending a brief email expressing your opposition to your Representative. I know you live in the Moore area, so that would probably be Terrill or Wesselhoft. Be sure and let them know you’re an actual constituent of their’s. While legislators are happy to read emails from across the state, it always means a lot more if we know we’re getting an email from someone in our district. I hope that helps.

Some info to help

If you can explain how this bill came into existence, you might use some of those points that were presented in Nevada, enabling them to beat the HSUS bill.
Remember, HSUS/PETA represent Animal Rights (AR) & do not operate any shelters. HSUS has assets of more than $200M and has an annual income of at least $150 million they get from donations. Their officers live lavish lives. AR members believe animals should not be considered property, so that way animals can be "taken" from anyone without legal recourse. AR people do not believe animals should be used for food, clothing, medical research or entertainment. AR groups do not want any hunting or fishing. The AR goal is to eliminate all meat, fish, poultry and dairy from American menus. The AR groups target pet owners first because they are easier to attack & the general public has no knowledge of the AR goals to eliminate ALL animal ownership. By attacking those with multiple dogs, the AR groups have effectively removed the future of shows and hunting.
