I read that they are allowed because they have a function to turn off the tone?

Turn on "competition mode" and a visual on your handheld (phone).
Pretty neat .

So if Garmin put out a update that did the same thing would UKC allow them? It would not be hard for them to do it.

If you can turn it off couldn't someone just turn it back on? How can you tell if they have turned it on or off?

...once it's in "CM" it stays in that mode for a set time period (10) hour lock, u cant tone.
