Posted by dlinkous on 02-02-2017 08:56 PM:

send all an email and here is the response one sent back:

This bill passed the House Rules Committee earlier this week. The version that passed was significantly different than the original.
The substitute provides that, after appropriate notice, any dog owner or custodian who, without permission, allows a dog to roam onto the land of another both for the purpose of hunting or chasing game and in a manner that unduly burdens the landowner’s use and enjoyment of the property be subject to a civil penalty of $100 for the first occurrence and $250 for the second and subsequent occurrence on the same property.

The substitute specifies (i) that notice must be in writing or by a posted sign, (ii) that there can be no more than one actionable violation within a 24 hour period, irrespective of the number of dogs involved, and (iii) that the landowner is not to restrain or detain the dog except for purposes of prompt identification.

Penalties for violations of the statute will be received by the locality (not the landowner) and will only be imposed by a court after a landowner has proven with exceptional evidence that the statute has been violated.

Again, thanks for reaching out to me on this important issue.
Regards,
Kirk Cox

HB 1900

This bill is garbage just gonna make alot of hard feelings and tie up the legal systems in the counties. The way i read the amended bill to me it was any dog not in control of its owner. This affects all hound hunters in Virginia, if you say it is not that bad next year they will come back and take a little more till you won't be able to run hounds on any game. I think there are alot more important issues they should b worried about.

Posted by Leesmere Farm on 02-02-2017 10:33 PM:

Sounds like to me that Mr. Kirk Cox has his mind made up to vote to pass this bill. Need to make sure he remembers who had the choice in electing him in to office. This is a terrible bill for all dog owners not just hunting dogs.

Well, whatever law enforcement officer that charges you has to be able to prove what he's charging or it gets thrown out. I don't think anyone is going to get charged just because a landowner says so. My thing is how does anyone prove it except to catch the dogs or have photos of them and then you still have to figure out who's the owner. I always have bear dogs running around on my property over near Natural Bridge during the running season. Most of the time they don't even have collars on them and I have tried to catch them to see if I can return them. They never really hurt anything but I seriously doubt the "rightful" owners would ever claim them anyway.
Gamewarden pulls up to your house with a dog in the backseat and his ticket book in hand and asks, "This your dog, sir???" only to get the Mexican "what" look.....
Not saying it's not a bad bill, I just don't really see it working out too good or otherwise accomplishing much. Generally, when I see things that don't make any sense I start wandering what's the real reason for this??? Foot in the door to go after a bigger fish????

HB 1900

What i hear they have amended the bill again to exclude dog west of the blueridge. The big thing they are after are deer dogs but all houndsmen need to stick together an stop this bill. They are trying to divide us. They do away with deer dogs then they won't stop there. I have heard that HSUS is in support of this bill an we all don't need them cause they are against all hunting. If you haven't done so please contact your house representatives an tell them to vote no on HB1900. United we stand divided we will all fall.

HB 1900

HB 1900 was defeated this morning by a single vote. For now it is dead but can be brought up for reconsideration should some of the legislators think they can swing one or two votes.

It is being amended now and will come up for revote this afternoon since it was so close. The word on the street is that the ammendment will exempt fox hunters on horseback from the ramifications outlined in the bill. If you have a personal contact with any of the delegates you need to get on the phone NOW!

According to VDHA the house speaker has decided not to bring the bill back up for vote. We have won for now but this is not over. My girls an myself would like to thank all that contacted the delegates an the hunter that made it to Richmond, I heard over 300 showed up I know there were a lot of people there. We must stay vigilant an stuck together cause this ain't over yet , and remember the delegates that voted for this when election time comes.

Is it possible that it's not over for this legislative session? I'm guessing the state Senate is going to take this up for a vote then if it passes it'd go to the house? Been a while since I took that govt class in school.

I believe it is over unless new legislation is brought up. The bill in your link I believe has been defeated by the Senate already. I could be wrong but think that bill has already been struck down.

Sb 1525

It died in committee wording throws you off i saw your link an went to it and took double take then went to the VHDA web site to make sure cause I thought it was killed, and it had been. But they will continue to try to get laws passed to stop hound hunting.
