THE DEFINITION OF "ON A DOG HUNT", TO PROVIDE FOR THE DEFINITION OF "TAKE", AND TO ASSESS A CIVIL FINE NOT TO EXCEED FIVE HUNDRED DOLLARS FOR VIOLATIONS THEREOF.

TO AMEND CHAPTER 11, TITLE 50 OF THE 1976 CODE, RELATING TO THE PROTECTION OF GAME, BY ADDING A NEW SECTION TO PROVIDE THAT IT SHALL BE UNLAWFUL FOR A PERSON ON A DOG HUNT TO PERMIT HIS DOG TO ENTER UPON THE LAND OF ANOTHER OVER WHICH THE PERSON DOES NOT HAVE HUNTING RIGHTS, TO PROVIDE FOR THE DEFINITION OF "ON A DOG HUNT", TO PROVIDE FOR THE DEFINITION OF "TAKE", AND TO ASSESS A CIVIL FINE NOT TO EXCEED FIVE HUNDRED DOLLARS FOR VIOLATIONS THEREOF.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Chapter 11, Title 50 of the 1976 Code is amended by adding:
"Section 50-11-775. (A)(1) It shall be unlawful for a person on a dog hunt to permit his dog to enter upon the land of another over which the person does not have hunting rights. The provisions of this section apply whether the person in control of the dog intentionally or unintentionally releases, allows, or otherwise causes the dog to enter upon the land.
(2) As used in this section, a person is 'on a dog hunt' if the person is using dogs to assist in taking a game animal, hog, or coyote.
(3) As used in the section, 'taking' means harassing intentionally, hunting, capturing, gathering, harvesting, removing, catching, wounding, or killing, or attempting to harass, hunt, capture, gather, harvest, remove, catch, wound, or kill.
(B) A person who violates this section shall be assessed a civil fine in an amount not to exceed five hundred dollars. Fees received for these violations shall be deposited in the State Treasury to the credit of the General Fund of the State. Violations of this section do not by themselves trigger the penalties imposed under section 50-11-770.
(C) It is not a violation of this section if a person, with the landowner's permission, uses a single dog to recover a dead or wounded animal on the land of another and maintains sight and voice contact with the dog.
(D)(1) The provisions of this section do not apply to bear hunting.
(2) The provisions of this section do not apply to Game Zones 1 or 2."
SECTION 2. This act takes effect upon approval by the Governor

The proposed law is ridiculous. Fight it and fight it hard. They need to know what the economic impact will be for hunts like "the Grand American", and all the other hunts statewide. A lot of money pours into your state from these events. If that proposal were to pass
, I would never hunt in SC again.

Better do something. You already have to get a permit to run em here and seems like land sizes are a issue here to. Its not legal where I hunt. So list us some contact info on who to email.

I said ROGUE Deer Doggers not law abiding Deer doggers they are the ones I'm talking about they make us all look bad.Talk to your Senators and House members that go to Columbia.Explain to them that 1% is the ones causing this problem.

I disagree, the ones causing the problem are these corn pile deer hunters. They hate dogs, any dogs, and all dogs!

Agreed. But I tried to post a link on who to contact but can't figure it out. All I did was Google SC fish, game and forestry committee and SC state senators. If someone has a better way post it up.

I have already met with several senators on the committee who are hunters/ pro-hunting. None of them are for this bill.
But, if no one complains things like this slip thru.

Ok it a proven fact that Coondogs do not hurt deer hunting, I've been looking a tree over with deer bedded down watching me. And if I go deer hunting and hear dogs of any kind coming thru the woods it normally makes for a better chance of having some deer pushed over on me. This bill is crazy, people are so jealous on what's mine and not yours.

Law

They recently passed the renegade law two years ago.(or so). That law was introduced to do exactly what Mike Flemming was talking about with the deer dogs. This law will be beat in court if passed. Number one how can you exclude bear dogs? Number two how can you exclude game zones 1 and 2? This law is written similar to the old baiting for deer law and it was beaten many times over. This law is also civil which will not effect hunting license points (no suspensions) and can not move up in statute first offense, second offense and so on. I hope it does not pass, it will cause unnecessary headaches for hunters and landowners. This law would give an option to law enforcement on charging the more serious and criminal charge of the renegade law, or this civil charge. Anyway, restrictive law to hound hunting is not good for any of us.

I have met with the Senator who introduced this bill. He didn't intend for it to affect anything but deer dog hunting so he has agreed to table it for now.

When it comes to deer dog hunters, yes a finger can be pointed, it can be pointed at the ones that go out and tear hell of hinges on other folks property or the roadsides with their trucks. There are "some" that go out and have zero respect for anything. Those are the ones that are gonna ruin it for you guys that run dogs. However, When it comes to coonhunters, the finger can be pointed at the ones that drop tailgate in a subdivision and tree in the only **** tree in a person yard, or disrespect property owners and that go out and tear hell of hinges as well. There's ass "O" like those that cause people to take actions like theyre doing down in SC, done in GA and will eventually do in every state. It's not gonna get any better for us until we start to cull out the ones that are hurting more than helping.

I'm sure by a few of my post, it's clear to see that I'm a pretty big advocate for getting rid of the trash. I see the destruction they are causing both with the gov. and with the locals that are patient with us for the most part. What is happening is what has for so long been seen as "Right" is quickly becoming a privelege that has an expiration date. I've said this several times and I'll say it again, we all know who these folks are that are causing the damage, it's your duty to call them out, thats the only way to clean things up. We have to police our own!!!!! The ones that would love nothing more than to see our hunting rights taken away aren't gonna come out and tell us to clean it up, theyre just gonna let us keep stepping on our cranks until they have enough to drop the hammer and revoke that "Right". Once they take them, good luck getting them back. Trust me, it's alot easier to try an explain to a hunting buddy/hunter why they need to clean up their act than it is to a politician why they should allow you to hunt and why they should give you that "Right" back.
