Whats the penalty?

4 dog cast and 3 dogs declared struck. Dog A is declared treed, wait the five minutes, and score the tree. As the cast is walking away from the tree to listen for the other dogs handler A cuts his dog without any of the struck dogs opening. None of the other dogs barked and the 8 minutes was never ran and the question is what is the penalty? Is the dog scratched, does the handler just get a warning and scratched on the second offense, or is there another rule.

Implied scratch, page 121 Advisor.
Anytime you do anything the rules say you can't do, or you fail to do something the rules say you must do, you are scratched under the implied scratch.

why would he be scratched? The judge should have done his job and started the 8 on the other dogs since dog A was not struck in the 8 would not have applied to him. Please explaine.

Really: Its up to each handler to know the rules. The rules plainly state that the dog cannot be cut loose until another dog opens or the eight catches the other dogs.
