OSHA
Used to if some one got injured on a construction site, that was the time OSHA would come out investigate and handed down any fines or penalties. Recently the OSHA inspectors have been proactive in residential construction. I have never in 30 years of working construction ever seen an OSHA inspector on residential construction site. A local painter was fined $7,000.00 for not wearing a respirator. A carpenter was hit the same amount for not wearing safety glasses while using a skill saw. The stories go on. I'm not against safety by any means. I just think the fines are way too excessive. I have read where funding was cut and OSHA has to make up the difference. Carpenters can no longer walk top plates, roofers must wear fall protection devices, or build scaffolds with handrails all around the house, or put up nets. Just another way to hurt small business. Has any one experienced any of this?

Yes....I have a management postion with a company of 100 employees....not OSHA but Dept of Transportation started a new scoring system (CSA 2010) that is in so many ways ridiculous. I preach safety to my warehouse and truck drivers EVERY Day...so I am all about these guys going home in one piece. But our goverment has decided that common sense has no place around work..they are trying to regulate everything.
I worked for the goverment years ago and I realized that not everything is black and white, there is alot of gray...and that you cannot control every facet of people's lives. Choices are made and consequnces follow. That's life....survival of the fittest I suppose.

this just didn't start with obama...it's been going on for years, hell they don't even need to come on site anymore, they just sit and video tape you.....you guys want to see bad just come work in illinois.....5000.00 is a drop in the hat around here, hell thats what the big companies pay them to stay away....LOL... try like 150,000.00 now thats a fine!!! and thats just a visit to the site, if someone gets hurt well you might as well just shut the doors because the fine will put you out of business anyway.....around here if you low ball another contractor they just wait till you start the job and then pick up the phone and make the call " i'm really concerned about the safety on this site" few hours later hello OSHA and thats 25,000.00 to start... Don't want to ruffel the feathers but there is no way your throwing the tickets in the garbage and getting away with it...the fines don't go away unless you like back paying OSHA thousands of dollars with interest....
The Obama admin is creating jobs that's for sure. OSHA is hiring and rolling along because the new inspectors have to generate revenue to pay their salaries. Since OSHA was established they have gone through periods of being more or less aggressive but now the gloves are off since they have set goals to lower the number of reductions on fines and increase the number of fines levied. If you determined your job security by how many fines you hit working folks with could you sleep at night. No need to wonder why the jobs are going to Asia and south of our border. The Obama administration is both milking the cow on one end and butchering it for steaks on the other.
I've been reading up on the OSHA website. There is a new design for the logo. Looks like the same graphic designer as Obama's.
I showed this post to my nephew he's had his own construction business for about 10 years now he just laughed. He said he don't know how the laws read in other states but here OSHA only matters on how the contract is draw up as far as private construction or residentional goes. If it's goverment work or working inside a factory or jobs that are4 closely monitored by osha yes you have to go by it cause 99% factories and such have to go by OSHA regulations. He said they tried to fine him just recently for one of his workers not wearing a hard hat. He called his lawyer right in front of them his lawyer talked to the osha guy ( which the OSHA GUY tried to refuse to talk to him ) when it was said and done the osha guy took the ticket and tore it up stumped off mad and said someday this BS will change. My nephew said as for as blaming OBAMA!! which i'm democrat but hate this guy he said these laws have been in affect long before he came in to office. It's just osha trying make money on people not knowing the law. I don't care who it is or what they say if i'm not sure i'm questioning any fine someone hands me.

they dont have as much power as people think ,trust me ive told them many times to get out of my face and get off my job site and they just leave , had one cut my cord once cause the ground fell off the cord ,i made him give me money to buy a new one ,there was nothing in my contract saying i had to follow any OSHA rules

SOME of the laws were in place, but this administration has implemented an unprecidented new RECORD of new "regulations".
And at the same time they have openly made sure OSHA and other agencies were MORE agressive toward any US business they can in any way try to control.
At the same time they have openly chosen NOT to follow immigration law and have publicly stated they would ignore deportation laws.
That's the difference, it's the "open season" declared on small business complete with the added regulations that have throttled business in this country.

OSHA is federal law and is that plain and simple. I own a construction company and have spent a lot of money trying to avoid them. Here in Ala they can come on any job any time. You tear up a ticket here and they can put you in jail. I dont do much residential work but i have a lot of subs that work for me that do and they tell me they deal them misery. I dont like to even talk about OSHA, I get fighting mad.. They drive up on a jobsite here and they have already got you on film most of the time......
The way that I look at it, the reason that they have laws about certain things is because of an incident in the past. It is the same reason that hair dryers have warnings on them not to use them in the shower or deodorant has a warning to not use it on your eyes.
Actually, OSHA has been giving the heads-up to contractors that they are going to do a jobsite visit about 24 hours ahead of their arrival for a long time. And your insurance carrier (if you do work properly and safely) will usually pass cost savings on to you for your workman's comp.
The fines that they pass are negotiable. I know that my ex-employer, a water well drilling company, had two employees killed doing my old job after I left. The guys were not trained to handle the situation and they were in a confined space using chemicals with no rescue apparatus in place. The company ended up with 17 violations and a $17,000 fine that was reduced to $1700 because they paid it up front. The woman that owned the company sold it within the week to avoid the possibility that the families of the victims would have any recourse.
In order for OSHA to investigate a problem, the complainant either has to be a current employee or been one within the last 6 months. They cannot just walk on any job site without permission unless there has been a death or significant bodily injury. However, if you deny them entry or threaten them and they witness a violation, they can contact your local law enforcement agency to assist them.
There are a lot of new laws and regulation that are in effect now or will be shortly. If you chose to ignore the law, then prepare to pay the cost. You can get a copy of 29CFR1910 and read it or go online and look for specific items.
If you cut the ground off of a cord, then the cord is to be rendered unusable. Granted the inspector should not have cut the cord, he should have handed you a citation for a nice fat fine attached instead. They cannot physically disable or destroy anything on jobsite, only tag it as unusable.
Pass the cost on to the consumer? For what...safety equipment, good training, good work practices? If you don't spend the time and effort working safe, you are on borrowed time and your business/home/personal life have little value to you anyway. And explain how you place a value on someone that takes a fall and breaks his back, trips on a jobsite and impalls himself on rebar, or looses an eye/hearing/use of a limb because they or you removed a guard on a piece of equipment?
Lawyers and lawsuits run the businesses today. Don't kid yourself and think anything else. If you try to save 10 minutes by doing something without regard for you or your employers safety and lifelong health, then don't be suprised if you are the guy sitting along the road with a sign that say will work for food.

It USED TO BE that OSHA would'nt come on a job unless called or unless it was a big commercial job being done by union workers. Its just not that way anymore. For you guys that think they cant just walk on your job and start writing tickets, well ya might be in for a big supprise. They just got a non-union contractor on a small residential job up here by me about a month ago. Over 30k in fines. As an employee you can not let them on the job until the boss gets there, but thats it and thier still gonna be writing tickets and video taping you while they wait. This is'nt the same old OSHA that some of you guys are thinkin it is. They've recently put on more employees and are pushing to make themselves a good source of income for the gov thank's to Obama.
