ATTN: NC hunters: HB755 Amend Fox Laws

URGENT: They calendared this bill today!

“Amend Fox Laws” House Bill #755 – Attempted Power Grab by WRC

Call or email the NC House Agriculture Committee members immediately!



Bill to be heard Tuesday, May 24, 2011 at 1:00 pm in Legislative Office Building Room #643



The NC Wildlife Resources Commission seeks exclusive authority over fox hunting & trapping. HB#755 would repeal all local fox laws. It would grant ALL power to the WRC to allow or disallow hunting and trapping of foxes. All county fox rules could be changed at the whim of the unelected WRC and staff. There is no guarantee county traditions would be respected or preserved.



Section 3 (on page 2) of HB#755 contains the following proposed language:

To the extent that the Wildlife Resources Commission rules for taking foxes conflict with any provisions of any local act, the Wildlife Resources Commission rules prevail. The fact that a local act in conflict with the Wildlife Resources rules for taking foxes has not been specifically repealed does not indicate an intent for the local act to prevail.



The NC Sporting Dog Association opposes House Bill #755. We are deeply concerned about this attempt to consolidate power in a government agency to the exclusion of elected legislators. Hunters must not lose our right to petition the legislature on hunting issues. If the WRC grabs the power over fox hunting, it will only be a matter of time before they seek all control over all hunting with dogs.



We understand Gordon Myers, Executive Director of the WRC, is drafting a Proposed Committee Substitute for HB#755. We have not been consulted in any way at all. We do not know what such a PCS would contain, but we remain deeply concerned. Please alert House Agriculture Committee members of our opposition to HB#755. We do not need this bill.



Contact all members of the NC House Agriculture Committee. The Representatives have gone home for the weekend. Please contact them in their home districts as much as possible this weekend. The NC General Assembly website has the home contact information: www.ncleg.net.



With courtesy and respect, politely ask each Representative to vote AGAINST HB#755.

Amend Fox Laws HB#755 was discussed in the House Agriculture Committee.

No vote was taken. We expect this bill to come up again next week.

Call or email House Agriculture Committee members and ask them to vote against it.

HB#755 would take away local control of fox hunting/trapping laws.

HB#755 would consolidate more power in the NC Wildlife Resources Commission.

Thank you Fox Hunters! You helped save the day!

Thanks to everyone who worked against “Amend Fox Laws” HB#755.



Today, we were able to change HB#755 into a Study Bill. There will be meetings during the interim between the end of the 2011 legislative session and the beginning of the 2012 legislative session. The NC Wildlife Resource Commission will report back to the NC General Assembly on or before April 1, 2012.



The issue of foxes will be studied by the NC Wildlife Resources Commission. We will be involved in the study. Fox hunters, please be ready to attend some meetings!

The bill will now go to the House for a full floor vote on Wednesday, June 1, 2011. Then, it will cross over to the Senate. We will keep you advised of the progress of HB#755.



This transformation into a Study Bill is a good development for us. The NC Wildlife Resources Commission cannot do anything now until the study is completed, and the matter returns to the 2012 legislature.



We will have the opportunity to provide information and protect the process of gathering correct information about foxes and coyotes in North Carolina. The process cannot be taken lightly, however. Keep in mind the study will include all foxes and coyotes, including outdoor fox hunting, wildlife pens, and trapping. We must be heavily involved in the process in order to provide accurate information to the NC Wildlife Resources Commission and, ultimately, to the NC General Assembly.

5/31/11 LATEST TEXT OF HOUSE BILL #755 Edition Three



A BILL TO BE ENTITLED AN ACT TO DIRECT THE WILDLIFE RESOURCES COMMISSION TO STUDY FOX AND COYOTE POPULATIONS AND REPORT ITS RECOMMENDATIONS ON MANAGEMENT METHODS AND CONTROLS TO THE 2012 GENERAL ASSEMBLY.



The General Assembly of North Carolina enacts:



SECTION 1. The Wildlife Resources Commission shall undertake a study of fox and coyote populations in the State and recommend management methods and controls designed to ensure statewide conservation of fox populations while managing adverse effects of coyote populations. In conducting the study, the Wildlife Resources Commission shall solicit input from interested stakeholders, including hunters, trappers, controlled hunting preserve operators, public health authorities, local governments, the North Carolina Department of Agriculture and Consumer Services, and private landowners. The Wildlife Resources Commission shall complete its study by April 1, 2012, and submit a report, including any proposed legislation, to the Speaker of the House of Representatives and the President Pro Tempore of the Senate, the Chairs of the House Committee on Agriculture, and the Chairs of the Senate Committee on Agriculture, Environment, and Natural Resources. The Wildlife Resources Commission shall conduct the study within existing funds.



SECTION 2. This act is effective when it becomes law.
