neighbor killed coon dog.need info on laws

I was wondering if you all could give any info. to help me understand the law. My cousins bluetick pup got out of the lot yesterday and the neighbor feed it poison and when he went down he shot him in the hind legs. The poor was laying suffering when they found him. He died a few minutes later. The neighbor said he got in his garden. We called the police and the said it was a misdemeanor. We live in West Virginia. I hope someone may know the law better then us and can give us some help.

Killing a dog that come into your yard may be a misdemeanor, but generally intentionally causing suffering is considered animal cruelty, and would be a more serious charge. Both poisoning and shooting to NOT kill should be classed as animal cruelty.
I would pursue it with the police, and with the local state's attorney.

There is actually a story in the June issue of Bloodlines regarding what to do if you have a dog shot.

1. Camera document is a really good suggestion per the article.

2. Get Law enforncement involved immediately.

You need to call the DA and the local papers or TV stations and light some fires if you want your neigbor to feel the heat.

You live in West Virginia? I thought you could legally kill someone for maliciously injuring/killing your coon/bear hound in W. Virginia. Try this.... send the one that killed your dog a thank you note claiming that the poor dog was dieing of 'sars' or whatever disease you can think of.... in the letter state that they did you a favor by putting the dog out of his misery also give a free dinner certifcate to any restaurant you might have in your area. Then two to three years from the date go on vacation to Kentucky, Maryland or where ever. Then have one of your friends or family to kill and burn everything they own. I have a friend that had a Dual Grand killed in W. Virginia a few years ago. He got absolutely nowhere with the authorities. Everything would have been taken care of if the guy that was hunting the dog hadn't ran his mouth so much. Anyways if you get any justice it'll surprise me. I'm truly sorry to hear about your dog and whatever you do I wish you luck.

hard luck

buddy im not sure what the law there is,but in tx if he can prove hes has been messing with livestock of destroying private property the authorities want hardly do anything,yea we have a bunch of tree hugging liberal law makers here in tx,but if something like that happened like that around my area of tx,id wake up one day and here that something awful happened to my neighbors something,i hate it for ya man.
