rule ?

3 dog cast. All dogs are treeing. Walking to the tree and 2 dogs are seen latch ahold of each other at the same time. The vote is of course against the one guy who votes scratch. Is this just a bad deal or can the judge still scratch the 2 dogs.

No, it's not just the judges decision.
Question it and take your explanation back to the MOH/Panel. If you conduct yourself intelligently, I would not bet against you winning that one.
Fact is, if you make it clear that it is going back to the MOH, at least one of them will probably cave and take their scratch .
