The Mercer County Commission is considering a proposal that would impose mandatory spay/neuter and breeder licensing requirements on county residents in order to address animal population concerns.
The Commission is expected to take public testimony on this measure at its December 13, 2011, meeting. All responsible dog owners and breeders who reside or compete in events in Mercer County are strongly encouraged to contact the members of the Commission and politely ask them to oppose this unfair and ineffective ordinance. Summary:
The AKC Government Relations Department has numerous concerns with this proposal, including:
•Mandatory Sterilization of All Dogs and Cats – All dogs and cats over 6 months old must be sterilized unless the owner purchases a $50 unaltered animal permit for each animal owned.
In order to qualify for the permit, owners must prove to the County Clerk that “the permit is sought for a proper purpose” and have not had more than one violation of any provision of the animal code in the past two years. Owners must also have the pet examined regularly by a veterinarian, vaccinated annually, and housed properly. These terms are not defined, and it is unclear how these requirements would be determined and enforced.
•Breeder Permit Requirements – In addition to the unaltered animal permit, an owner must purchase an annual $30 breeder permit for each animal bred. The permit would allow one litter per animal each year and allow animals to be sold, adopted or transferred once they are seven weeks old, as long as they have been “immunized against common diseases.” The proposal does not state which diseases it considers common.
The AKC opposes breeding permits and mandatory spay/neuter laws for purebred dogs. Instead, we support reasonable and enforceable laws that protect the health and welfare of dogs without restricting the rights of responsible owners and breeders who meet their responsibilities. We believe that all owners, regardless of whether or not their pets are intact, should be responsible and provide proper care for their animals.

This alert has been updated to correct the name of a Mercer County Commissioner.

Thanks to the numerous phone calls, letters, and large number of concerned responsible dog owners who attended the December 13 hearing, the Mercer County Commission has agreed to table the proposed ordinance that would have imposed mandatory spay/neuter and breeder licensing requirements on county residents.
A second public hearing has been scheduled for Tuesday, December 20, to allow residents another opportunity to address the commission on this issue. The meeting details are as follows:

WV Seeking to Enact Breeding Restrictions, Ownership Limits

The West Virginia Senate President has introduced a bill that would impose numerous restrictions and unannounced inspections twice a year on those who “maintain” eleven or more intact dogs over the age of one year and sell 15 dogs in a year.
Senate Bill 406 is currently pending in the Senate Judiciary Committee and is expected to move very quickly. It is imperative that responsible West Virginia dog owners and breeders, as well as those who participate in dog events in the state, contact both the committee and your State Senators to ask them to oppose Senate Bill 406 as introduced. Summary:
Senate Bill 406 seeks to impose numerous restrictions on “commercial dog breeders”, defined as those who “maintain” eleven or more unsterilized dogs (males and females) over one year of age and sell over 15 dogs in a year. AKC takes a strong line on animal cruelty, and does not believe any dog should be kept in conditions where its basic needs are not met. This is why AKC supports current West Virginia law (§61-8-19), which, among other provisions, makes it unlawful for anyone to withhold proper sustenance, protective shelter and medical treatment.
As currently written, however, SB 406 would create numerous burdens on dog owners and taxpayers without protecting the health and welfare of dogs. AKC’s concerns include:
•Definition of “Commercial Dog Breeder” – As currently written, the low threshold of owning 11 intact dogs and selling 15 dogs in year could impact hobbyists, sportsmen, and others who breed, raise and own dogs in their homes. It is unreasonable to expect such individuals to comply with the same requirements as large commercial kennels. In many breeds, 15 puppies constitutes only 2 litters.
•Ownership Limit – SB 130 limits ownership to 50 intact dogs. Laws that limit animal ownership are ineffective, arbitrary, and do not address the underlying issue of responsible ownership. Limiting the number of animals a person may own will not automatically make them a better owner. Furthermore, both the dogs and West Virginia taxpayers lose, as owners may be forced to give up their dogs to a local shelter in order to comply with the limit (particularly since those over the limit would only be given 30 days to come into compliance), and the dogs will be housed and/or euthanized at great cost to local communities.
•Arbitrary Breeding Ages – SB 406 would only allow females between the ages of 18 months and eight years to be bred. Arbitrary limitations on breeding ages do not adequately address the needs of individual dogs. Breeding is a health care decision that should be made by the dog’s owner in conjunction with a veterinarian. AKC has asked the committee to remove the breeding ages, and instead to require the breeder to have the female be examined by a veterinarian prior to breeding.
•Bi-annual Inspections – Unlike other breeder regulation bills introduced in West Virginia, SB 406 requires twice yearly inspections that are unannounced. AKC believes this is a violation of the rights of responsible owners as well as a major, unnecessary burden for West Virginia taxpayers.

The West Virginia Senate is expected to vote early next week on Senate Bill 406, a bill which, as amended by the Senate Judiciary Committee, would impose onerous restrictions on those who own 11 or more intact dogs. While some exemptions are included, the AKC believes they are vague and may still impact hobbyists who are not truly commercial breeders.
It is imperative that responsible dog owners and breeders in West Virginia contact their State Senators TODAY and ask them to vote “no” on Senate Bill 406. Summary:
AKC takes a strong line on animal cruelty, and does not believe any dog should be kept in conditions where its basic needs are not met. This is why AKC supports current West Virginia law (§61-8-19), which, among other provisions, makes it unlawful for anyone to withhold proper sustenance, protective shelter and medical treatment.
Senate Bill 406 as amended seeks to impose numerous restrictions on “commercial dog breeders”, defined as those who “maintain” eleven or more unsterilized dogs (males and females) over one year of age and breed dogs exclusively as household pets. The bill does provide some exemptions; however, the AKC believes these exemptions are vague and difficult to enforce.
AKC’s concerns with the bill include:
* Definition of “Commercial Dog Breeder” – This bill defines a “commercial breeder” as one who owns 11 intact dogs over the age of one year and breeds dogs exclusively as household pets. It also exempts anyone who keeps or breeds dogs “for the purpose of hunting, tracking and exhibiting in dog shows, performance events or field and obedience trials…” This would seem to imply that a person must keep dogs for all these purposes in order to be exempt, as it says “and”, rather than “or”.
Furthermore, it is not always possible to tell immediately if dogs from a litter will develop into proper show dogs, sporting dogs, etc. Many breeders will wait to watch the puppies grow before they determine if the dogs will be used for these purposes. It is unclear if a breeder would be exempt if they intend to keep or breed dogs for one of these purposes, but may ultimately decide to sell or keep puppies as pets. In the same way, a person may decide at some point to cease their hobby and “retire” their dogs, thereby keeping them as pets. The AKC believes that instead of vague exemptions that will prove difficult to enforce, the Senate should instead raise the threshold to a number more indicative of a truly commercial operation and ensure that hobbyists will never be unintentionally impacted.
* Ownership Limit – The bill also limits ownership to 50 intact dogs. Laws that limit animal ownership are ineffective, arbitrary, and do not address the underlying issue of responsible ownership. Limiting the number of animals a person may own will not automatically make them a better owner. Furthermore, both the dogs and West Virginia taxpayers lose, as owners may be forced to give up their dogs to a local shelter in order to comply with the limit (particularly since those over the limit would only be given 30 days to come into compliance), and the dogs will be housed and/or euthanized at great cost to local communities.
* Arbitrary Breeding Ages – SB 406 would only allow females between the ages of 18 months and eight years to be bred. Arbitrary limitations on breeding ages do not adequately address the needs of individual dogs. Breeding is a health care decision that should be made by the dog’s owner in conjunction with a veterinarian. AKC has asked the committee to remove the breeding ages, and instead to require the breeder to have the female be examined by a veterinarian prior to breeding.

The West Virginia Senate has passed Senate Bill 406, which would impose onerous restrictions on those who own 11 or more intact dogs. While some exemptions are included, the AKC believes they are vague and may still impact hobbyists who are not truly commercial breeders. The bill has now been assigned to the House Judiciary Committee.
There are only two weeks left in the West Virginia legislative session, and this bill is expected to move very quickly. It is urgent that responsible dog owners and breeders in West Virginia contact the members of the House Judiciary Committee and your State Delegates TODAY and ask them to oppose Senate Bill 406 as currently written. We appreciate some of the amendments that have been made, including removing arbitrary breeding ages and giving 5 days’ notice prior to an inspection. Still, Senate Bill 406 as amended seeks to impose numerous restrictions on “commercial dog breeders”, defined as those who “maintain” eleven or more unsterilized dogs (males and females) over one year of age and breed dogs exclusively as household pets. The bill does provide some exemptions; however, the AKC believes these exemptions are vague and difficult to enforce.

The AKC greatly appreciates the recognition that exhibitors, sportsmen, and other hobbyists should not be considered commercial dog breeders. However, we believe that the exemptions are vague. It is not always possible to tell immediately if dogs from a litter will develop into proper show dogs, sporting dogs, etc. Many breeders will wait to watch the puppies grow before they determine if the dogs will be used for these purposes.

Senate Bill 406, which would have limited dog ownership and imposed onerous restrictions on those who own 11 or more intact dogs, was held in the House Judiciary Committee and did not pass this session.
Although SB 406 did provide exemptions for anyone who keeps or breeds dogs “for the purpose of herding or guarding livestock animals, hunting, tracking or exhibiting in dog shows, performance events or field and obedience trials…”, the AKC believes these exemptions were vague and would not have truly protect hobbyists. In addition, the measure would have imposed numerous new engineering regulations, bi-annual inspections, and would have limited ownership to 50 intact dogs. Read AKC’s previous Legislative Alert for more details on Senate Bill 406.
The AKC congratulates and thanks the numerous dog owners and breeders who took the time to contact their legislators with concerns on Senate Bill 406, and to those who went to the state capitol to meet with legislators and worked tirelessly to defeat this legislation. AKC Government Relations was pleased to support their efforts by issuing numerous alerts, letters of concern, and working with legislators and stakeholders in opposition to the bill.
