What Would You Do

I sold a dog to a gentleman that does not live close to me at all. I recieved the check from him at the end of september. He said he would have her picked up in a week or two.. Needless to say she is still here. I have spoke to him only a handfull of times since then and evertime he says he will arrange to pick her up within a week. Now I am not a rich man and I told him that when I recieved the check I already had it spent so I dont have the money to give back. I am at a loss here I need the kennel space and now his phone number is not working. What would yall do?

WELL, SINCE YOU SOLD THE DOG IN SEPTEMBER, THAT WAS 6 MONTHS AGO. I'M SURE YOU DIDN'T MAKE A TON OF MONEY OFF THE HOUND. WHAT I WOULD DO, TRY MY BEST TO CALL THE FELLA ONE MORE TIME. IF NO RESULTS, FIGURE OUT WHAT A KENNEL WOULD CHARGE FOR BOARDING, ADD IN YOUR FOOD BILL, VET BILLS, SHOTS , WHATEVER YOU'VE DONE FOR THIS HOUND SINCE IT WAS "SOLD" INCLUDE ALL THE HUNT TIME YOU HAVE PUT INTO IT, AS NOW IT'S "TRAINING" NOT JUST HUNTING. ADD ALLLLL THOSE EXPENSES TOGETHER, IF IT COMES OUT TO MORE THAN WHAT THE GUY PAID FOR IT, DON'T WORRY ABOUT IT AND SELL THE DOG TO SOMEONE THAT REALLY WANTS IT. KEEP THAT ITEMIZED BILL, IN CASE THE MAN COMES FOR THE HOUND. SHOW HIM WHAT HE STILL OWES YOU IF THERE IS A BALANCE.

I had a similar situation several years ago with a pair of foxhounds. The man paid me in November but didnt have a dog box in his truck. He told me he would come back in couple of weeks. Well that summer i still had the dogs. I finally got in contact with him, and told him that if he couldnt come get them at the end of two weeks then i was going to sell them to someone else, and offered to meet the man halfway. I tried calling him even a month later, so i sold the dogs. I felt really crappy for doing it, because money isnt always easy to come by, and i have been in a situation where something would come up and i couldnt make it for a week or two. So i decided that unless i was going to deliver the pups myself, i would only take a deposit in advance, and they could pay the rest when they came to get them.

did you in any way keep or get his address? If you had access to it, (return label from the check) I would recomend sending a certified letter with a copy for yourself to him stating what will happen if the dog is not picked up by a certain date. If you do not have it I would recomend maybe the " Public NOTICE" section in your local newspaper and this should cover you legally. I am by no means an attorney but, I have seen different situations and this is how they have been handled for small claims court. I totally sympathise with you for this situation, obviously you are an honest man and this would understandingly be a difficult situation. Best of luck and hopefully all will work out.

Sounds like you were more than patient with him. You go stuck with a feed bill for quite a while so maybe it's a draw? It's a tough one, trying to do the right thing and all but...you cant wait around for ever. If there wasnt some circumstance like an illness, etc.. keeping him from coming and getting the dog then I'd say it's just laziness on his part. With that attitude I dont think I'd want that person having one of my dogs.
