need info

A man gave me two week trial on his dog with money up front. I called him and told him I wasn't taking the do 3 days before I was going to take him back. Know he won't return my calls what would you do. he told me in an email his phone wasn't working. Do I just go ahead and take legal action or give him a chance I don't care what it cost. I want to make these people pay if there going to sell dogs this way.
