He mentioned how he watched me walk out of the woods shining trees along this fence row. He then informed me that it was agaisnt the law to shine a tree at night without a dog under it. Of course he didn't issue me a ticket, but said he very easily could have even with my dog on the leash beside me. Just thought I'd share.

Thats all right, Dicky marked all them spots you guided him to for that 1350+. I'd say there is a strong chance he'll be back in there when the coon prime up. If you knew Dicky better you would of been camping his cast along the Murphy State Game Area. lol

Ben, Oh I know how Dickie is, a lot like me I guess spot and drop LOL. We had that discussion that night.
Thats good info on the shinning, did not know that.

DNR

Raccoon
(Regular)
Oct. 1 -
Jan. 31
With dogs only. Firearm must be unloaded and arrows un-nocked except when taking raccoon in tree.
Only lights similar to the type ordinarily held in the hand or on the person.
(Flashlights, portable battery-powered spotlights and headlamps, and similar portable lights designed to be carried in the hand or on the person are legal.)

The use of natural light, including night vision optics and scopes, is legal.

Only a .22 or smaller caliber rimfire rifle or handgun, or shotgun with loads other than buckshot, slug, ball or cut shell, or bow and arrow.

Raccoon
(Damage
Control)
July 15 -
Sept. 30
and
Feb. 1 -
March 31
Only on private lands when doing or about to do damage; landowners and guests only; with dogs only. Firearm must be unloaded and arrows un-nocked except when taking raccoon in tree.

I don't see anything in the rules saying you can't shine your light around to see what the coon population is.

Its probably falls under something else like shining. I am Not sure though.

Maybe you can if your not carrying a firearm. The point he made to me would fall under poaching he said. If its after shooting hours and your shining across fields or in trees with a firearm loaded or unloaded you can be issued a ticket.

Ben,

That ticket would be easy to fight as long as your gun is unloaded. You simply take the rules into the judge. Tell him your were just following the rules. I would also show a picture of a coon hunter with a head lamp and explain the light shines where you look.

The Law Enforcement Division often times interprets the rules to their liking, and the DNR can't figure out why their popularity is so low.

The biggest problem is most are unwilling to fight a ticket. I know a guy who has received 19 tickets to date, and he has successfully fought each one with just one trip to the court house.

Shining

This falls under the "shining laws". So outside the month of november, your good until 11pm. No shining during november unless on your own property. Then the whole issue of carrying a gun comes up. Your right about the headlamp. Most DNR will not issue a ticket for this, unless they are watching you shine fencerows, and killing coon without the dog treed. With the price of coon, who would do that.
Larry is right - if issued a ticket by the DNR, fight it. Many if not most can be beaten, without an attorney. Just know the law, do some research and your ok.

Brandon, I saw the photo of the winners last year. Scar looked good in that photo but you on the other hand is another story lol. No reason to break up the winning team if you and ben want to use scar again this year to go back to back you can come get her again.

One thing is for sure, when Scar is dumped in coon she can tree them like squirrels. She treed most of them coon in that picture.

Joe, I hunt alone. Thats the way I have hunted for years and I like it that way. I am sure you can fine someone to hunt with just not me. You are going to need a good light to beat Brandon and Ben. I think they may have the trail cams out getting ready for this year. lol
