thats interesting c/h.......here in virginia a game warden can come and go as he please's now he cant search or sieze anything without a warrent but he can trespass as he sees fit

In North Carolina you have to get permission to retrieve your dogs. Most people are perfectly fine with it in my area, but sometimes you come across buttholes. The other night my fiance turned our 2 year old female and my 9 month old female loose behind his house and they ended up treed across the road on private land. My fiance started walking to them, but the dogs just all of a sudden shut up. Once he got to the private property that the dogs were on, he saw a flashlight in through the woods...it was the land owner. He told my fiance that he was trespassing and that in the NC rule book it says that my fiance is suppose to call the game warden to escort him to retrieve the dogs. My fiance told the land owner that he just wanted to get the dogs and then told him that he doesn't know about the 9 month old dog but our 2 year old dog will not leave a tree like that unless you put your hands on her. The land owner told him that he took care of the dogs. My fiance asked him what he meant by that. The land owner said that he did what was necessary to get the dogs to get off the tree (but he wouldn't say what it was that he did to them). My fiance told him that he hasn't ever seen where in the rule book where it says that the land owner can put his hands on the dogs. The land owner then said well they were keeping me awake and if it makes you feel any better there's the coon and he shined his flashlight up in the tree. My fiance told him what would make him feel better is if he didn't put his hands on the dogs. Then the land owner told him that he needed to leave. We didn't get the dogs back till the next morning because of this.

Man I would hate to be a game ranger in those states. Can't immagin haveing to get up and go out in the night to seatle crap like that every night or go walk in and get peoples dogs for them all the time. I think I would tell the land owner he should try to get along and the dog owner he better teach his dog to come on command. Becouse I am not going to make a habbit of this.
Not trying to be an ass. That is just senseless to me.
The land owners know the dog will shut up if they let you go get your dog. The dog owner knows the dog is not going to stop at the property line. They know what the law is. So why would they turn loose in a small track with a dog not trained to come on command? Why would they not teach there dogs that before anything else.

This is Very Correct here in Virginia !!! If Someone Tells a Game Warden that He saw a Bait Site on Privite Property they can and Will "Stake-Out" the Site and Bust Anyone who happens to Hunt around it or Over it !!! With or Without the Owners Permision !!!!

The NYS HOUNDSMEN CONSERVATION ASSOCIATION has worked on getting this different, but alot of the sportsman groups are divided. The nyshca has done wonders in the state.

I have been told several times that a CPO can enter your home, barns, sheds, etc. to search for illegal game without a WARRANT, anytime he has PROBABLE CAUSE. Don't know if this is true or not??????????????????????

I've asked several Game Wardens here in east Texas, and they have all told me that if im coon hunting and i'm hunting on a piece of land that i have permission to hunt i can retrieve my dog. And if the land owner comes out and tells me to get off his property, I first explain what I'm doing get my dogs and leave. If he calls the law on me i have to wait and talk to whomever comes out there Sherrif/Game Warden, and show them i have proof that i can hunt the surrounding area of land.

Once I had a dog, go on someone elses land and get treed, I drove up to the landowners house, and explained, that I was hunting the National Forrest land next to his, and my hound trailed a Coon onto his property and treed it. I said, I just want to get my dog back, I will leave my gun and truck here, and walk down there, and get him.
To my suprise, the Landowner, told me to open the gate, and drive down there, and for Gods Sake, take your gun,and shoot out that Coon.
I did, and the guy has let me hunt there ever since. I wish it could alwayse work out this way.

here in virginia i have never been denide access when i was coon huntin but a whole diffrent story when im deer huntin with my deer hounds.

There are two main reasons they are trying to repeal it here in Va.

1. Deer hunters cutting their deer dog onto posted property under the pretence of going after their dogs.


2. Bear hunters doing the samething as the deer hunters.

Our right to retrieve law doesn't need to be changed they just need to enforce the laws that are in place already. They know where most of the complaints come from I'm sure so they just need to stake out those places HEAVY for awhile and write tickets to the ones that are breaking the law by turning their dogs loose on propertyy that they don't have permission to be on to start with.

A couple game wardens here have gotten permission to hunt in exchange to get trespassers oh yes they love to get coonhunters if your dog gets on someone else property here and you call the Game warden your getting a ticket

North Carolina does but you have to get landowners permission. If they say no then ya gotta get warden or sheriff's deputy to escort you or they are supposed to get your dog and bring it to you. Hope this helps

That's most everywhere but its not a right to retrieve. With a right to retrieve law you do not have to ask permission. The whole point is you can't be denied the right to go get your property.

A lot of guys think their state has a right to retrieve and they do not. I talk to guys here in Arkansas all the time that think we have a right to retrieve law but we do not.

The best thing to do is ask the land owner, most all of them will let you go get your dog. If they are real jerks and say no then politely inform them how much that dog is worth and if he does not allow you to retrieve it then he is taking responsibility for it if something happens.

We have it here in Georgia but if we didn't I'm going to get my dog regardless of what the homeowner says..there has been numerous times I have explained to a homeowner the rtr law and they still say no but I kindly tell them sorry you don't agree and I go anyways..I'm going to get my dog no matter where it's at..

you just need to get more DRIVE in your dogs, then as they are getting DEEP it gives you more time to read your States trespass laws.

I have spoken with several police officers here as well as the county game warden and all have told me the same thing..ask homeowner for permission if they say no call a police officer to escort you to your dog..maybe it's a county thing idk but all the other hunters here will tell you the same thing,that you must be accompanied by a dnr or cop..but like I said I'm not waiting 2 hours for a cop to show up.

That's what I was saying above. That's not a right to retrieve. That's asking permission. The sheriff nor the dnr can take you on the land unless they are given permission by the land owner. They are not allowed to trespass anymore than a civilian. The only way they can enter without permission is in the investigation of a crime. In Arkansas you get caught twice and you will loose your hunting license.

I don't know the rules where you live but I know here a game warden can go on anybody's property he wants to ,when he wants to,and how he wants to whether they like it or not..I'm just going off what an actual game warden and police officers have told me.and I don't think they are in the business of lying.
