-- court case (dog killed) (http://forums.ukcdogs.com/showthread.php?threadid=86363)

Posted by Todd Kincer on 03-10-2006 07:15 PM:

I can't remember the specifics because this story was told to me, but in one case where somebody got a dog shot off the tree, the owner took his papers(UKC & PKC) to court with him(as I'm sure you did Marty) and the judge called both registeries and got appraisals. UKC appraised for $3500 and PKC for $2000, I think. Like I said, this was told to me and I'm not sure if either would do that, but that's what I was told.

good luck marty, i would say the best way to appraise a dog is to bring in classified ads from various sources on various dogs with similar degrees and age. something is worth what the market is willing to bear, this would be a perfect example of waht the market values your dog at.

we lost

Posted by Buckshot on 03-23-2006 07:49 PM:

Marty, I am sorry to hear this. Please fill us in more on the outcome. Did the judge explain why she ruled against you?

Posted by wakenda on 03-23-2006 08:02 PM:

What do you mean you lost?

Was the traper not guilty or did you not get the dollar amount you wanted?

Posted by Marty Waddell on 03-23-2006 08:28 PM:

I didnt get anything for Mae's death. The judge ruled that she was trespassing. He didnt take into account the differences in the testmony given by the other party. Basicly saying that My dog was where she shouldnt have been and it was my fault.

Remember this judges name next time election time comes up and I'll even help write up flyers to pass out, this NUT needs to removed from the bench

Sounds like some good ole home cooking Marty......

Maybe he has ties to the farmer or the family of the people involved

I'd make sure to pass this along to the newspapers as dogs don't read.........or I have not been able to teach mine that trick yet

Also we (Illinois & Iowa) need to start on our state reps to pass the law to remove those body traps from dry land !!!!!!!!!!

Wisc has a great law on how they have to be set, so coon hunters need to unite and start working to get this law changed !!

Sorry Marty but that just plan sucks !!!

Court case involving my ancestors. True Story. My great great great grandfather and my great great great grandmother was borned in Greenville South Carolina back in the early 1800's. To make a super long story a lot shorter, they met and moved in together and had 8 children in south carolina. South Carolina at that point in time did accept common law marriage. After there 8th child they decided to move to Georgia. Well keep in mind that my great great grandfather was there first born son. They moved to Georgia and bought 180 acres of land. Matter of fact just about 5 or 6 miles from where I live today. Well they soon found out after moving to georgia that Georgia DID NOT at that time accept common law marriage. So, they were legally and properly wed. AFTER THEY WERE MARRIED they had one more child, a son, there very last child. When both the parents died all the children expected to get an equal share of the inheritance. Well, to make a long and complicated story much shorter the very youngest son took the other 8 to court. He stood in court and told the judge that everyone of his brothers and sisters (including my great great grandfather who was the oldest son) were nothing but illigitamate Bas#@!$# and they did not deserve one single red cent of the inheritance. The judge SIDED WITH HIM AND GAVE HIM EVERY SINGLE BIT OF THE INHERITANCE!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
The house and the 180 acres. Well, the judges daughter turned up missing soon thereafter and was never seen or heard from ever again. True story. My Great uncle was an old man when he told my dad about all this.

Mark

I'm not much good at writing things up for the papers. I do think the judge was a trapper or ex trapper as he made it clear he knew all about conibears and snares. I really thought I had a good case and I will be writing the DNR and anyone else I can think of to get these **** conibears OFF dry land

Marty

Appeal to a higher court. The judges decision isnt the final word.

iowa dog killed?

i had a bitch killed that was directly off of whitey killed 2004 thanksgiving. in a two twenty going into a culvert. she was a nice bitch and had just been in her first hunt and got a first the week before it happened. I believed i was in the wrong for hunting her on public as this is where she was killed. needless to say i wont be hunting there during kill season anymore, i should have known better as i was coming home from college and stopped for a dump and it was her last. the ? is is there anything i could of done as i called the guy that night and told him why his trap was sprung... but i thought i was in the wrong and just took the lump as it came, as she was i think around five and could of easily been finished into grand and sold for prolly two to five thousand as she cost me two grand that summer.

i'm sorry that you lost your case. i agree with mark h. you need to campaign against that judge and educate the public. dog owners need to let others know we have rights too. and i agree my dogs are part of my family. to kill one of them is to kill a family member and i would want justice. (just don't do it sheepster's way. two wrongs don't make a right)

How can you site a dog for trespassing??? If Blue gets loose & nails the neighbors poodle are they gonna throw him in the pound for rape? I don't understand how people come up with some of this stuff. If the trap was illegally set then the guy doesn't even have a case. Sorry for your loss.

This situation happened not 6 months ago in the city where I work. A guys hunting dog went over the fence of a house where a bitch was in heat. This particular bitch happened to be a "champion show dog." I don't remember what kind of show dog, but I do recall the it was a useless little type of dog.

She offers up, and the 2 dogs get locked up. The owner of the "champion show dog" was furious and demanded a police report. A police sgt that has no backbone ordered the responding officer to take a report(no ticket was issued or arrest made) and now the owner of the pregnant bitch is taking the other dog owner to court siting losses because of the bastard pups.

Keep in mind that these people are neighbors that live across the street from each other.

Sorry to hear about the loss of your dog and your court case Marty. I would definitely appeal if you feel that you were wronged by the judge.

actually thats not too far off. i heard of a guy, i think it was on this board, where the female was loose and came over to his tied male. the owner of the female wanted him to pay the vet bill for getting rid of the pups. i never did read on how that one turned out.

been thinking. seems like the solution is going to be part Marks idea and part craigs. a campaign against the judge as well as justice for the mae. I'm sure he will wish he had just paid for my dog.

Marty

Well, good luck Marty. I believe you have the right idea. It will soon be primary time. You might want to check out running for your political party's county committee for starters. I am running a write in campaign to be on my party's county committee. I wasn't going to, but with PAWS and your situation and everything else, we hunters HAVE to get involved! I know you said you weren't much for writing, but again we as hunters are going to have to learn to be writers and politicians during our time off from being in the woods. Our hunting future depends on it, and no one else is gonna do it for us.

Marty; Was the 220 set on property he had permission on? If so it was a legal set and nothing can be done. I was a trapper before i was a hunter, and i still trap, and i use 220s. I donot set traps in timbers, only road ditches, and the way i set them, with cross-over stakes, makes it almost impossible to catch a dog. bait boxes and buckets should be outlawed, because the animal is funneled down to stick there head in it. Trappers need to have respect for the houndsman and not set there traps in a dog catching situation. Also hunters need to repect the trappers, and not steal there fur or traps if they are doing things legally. In my area all the big trappers and me as a hunter get along well, and they dont set 220s in a dog catching situation, and i dont steal there furs, or traps. There is always a few bad apples on both sides of the fence.

Marty was the trap in a fence row? If so how close to fence was the trap??

Posted by Marty Waddell on 03-26-2006 05:53 PM:

the trap was under the fence. This guy had a conibear or snare at every game trail around this timber.

Marty

Posted by hershberger on 03-26-2006 06:48 PM:

There is no restrictions on how close to a fence a 220 or snare can be set to a fence, EXCEPT in a road ditch on the road side of a fence. Then it must be 7 feet.If its on the opposite side of the fence and the landowner gave him permission then it can be right beside the fence.
